The Ministry of Home Affairs has responded to the civil service allowance regime for civil servants transferred to commune civil servants after the arrangement of administrative units.

Mr. Nguyen Quang Dung (character's name has been changed) said that according to Decision 759/QD-TTg in 2025, there is a regulation: "Conserving the current salary regime, salary policy and position allowance (if any) of cadres, civil servants and public employees assigned to work at the new provincial administrative unit after the arrangement for a period of 6 months...".

From this regulation, Mr. Dung asked: in the case of a civil servant belonging to a public service unit, who is not entitled to a public service allowance, when he or she is converted to a commune-level civil servant, will he or she be entitled to a public service allowance under the civil service regime or will it remain the same, that is, there will be no allowance?

Regarding his reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.

According to Clause 4, Article 11 of Resolution No. 76/2025 dated April 14, 2025 of the National Assembly Standing Committee on the arrangement of administrative units in 2025, it is stipulated that: Maintain the current regime, salary policy and position allowances (if any) of cadres, civil servants and public employees affected by the arrangement of administrative units who are still cadres, civil servants and public employees at agencies and organizations in the political system for 6 months from the date of the work arrangement document. After this period, the regime, policies and position allowances will be implemented according to the provisions of law.

At the same time, the Steering Committee for the implementation of the arrangement and reorganization of administrative units at all levels and the development of a model of organizing local government at both levels of the Government issued Official Dispatches: No. 03 dated April 15, 2025, No. 11 dated June 4, 2025 and No. 16 dated August 9, 2025 guiding the implementation.

Accordingly, the Ministry of Home Affairs proposes to maintain (reserve or continue to receive) allowances in accordance with the instructions in the above documents.
