Decree 16/2025/ND-CP amends and supplements a number of articles of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on the organization and construction of forces and regimes and policies for Militia and Self-Defense Forces.
Decree 16/2025/ND-CP takes effect from March 23, 2025. Accordingly, Decree 16/2025/ND-CP
Decree 16/2025/ND-CP amends and supplements Clause 4, Article 12 of Decree No. 72/2020/ND-CP, which stipulates one-time social insurance for standing militia as follows:
The permanent militia has decided to recognize the obligation to participate in the permanent militia or to resolve the obligation to participate in the permanent militia before the time limit according to the decision of the competent authority but not eligible to enjoy the monthly pension as prescribed, if there is no aspiration to reserve the time to pay social insurance and do not continue to participate in voluntary social insurance, they are entitled to one-time social insurance as prescribed in Decree No. 33/ND-C-CP of the Government. The one -time social insurance level applies as prescribed in Clause 2, Article 60 of the 2014 Law on Social Insurance.
Compared with the regulations, the one-time social insurance benefit level for standing militia is calculated based on the number of years of social insurance contributions, each year is calculated as follows: a) 1.5 months of average monthly salary for social insurance contributions for years before 2014; b) 2 months of average monthly salary for social insurance contributions for years from 2014 onwards; c) In case the period of social insurance contributions is less than 1 year, the social insurance benefit level is equal to the amount of contributions, the maximum level is 2 months of average monthly salary for social insurance contributions.
