Article 41 of Decree No. 115/2020/ND-CP stipulates the consideration of special promotion of professional titles for civil servants as follows:
1. Officials who meet the standards and conditions specified in Points a, b and c, Clause 1, Article 32 of this Decree shall be considered for special promotion to a higher professional title rank when recognized and appointed to a position with a requirement for a professional title rank higher than the current professional title according to the provisions of specialized law.
2. The head of a public service unit shall have a document accompanied by a copy of the documents proving the standards and conditions for considering the promotion of civil servants as prescribed in Clause 1 of this Article, and send it to the head of the competent authority managing civil servants for consideration and decision.
Points a, b and c, Clause 1, Article 32 of Decree No. 115/2020/ND-CP, amended by Clause 16, Article 1 of Decree 85/2023/ND-CP effective from December 7, 2023, are as follows:
Article 32.Standards and conditions for registration for consideration for promotion of professional titles 1.
Officials are eligible to register for consideration for promotion to a higher professional title when meeting all of the following criteria and conditions: a) Be classified as having completed their tasks well or better in the year of work before the year of consideration for promotion to a professional title; have good political qualities and professional ethics; not within the disciplinary period; not within the time limit for implementing regulations related to discipline according to the regulations of the Party and the law; b) Have the capacity, professional qualifications, and skills to ensure a professional title at a higher level than the current professional title rank in the same professional field; c) Meeting the requirements for a diploma, certificate and other requirements of the professional title standard for consideration for promotion.
In case at the time of promotion consideration, the Ministry managing professional titles of specialized civil servants has not issued regulations on the content, program, form, and time of training according to the provisions of Clause 1, Article 64 of this Decree, it is not necessary to meet the requirements for a training certificate for professional titles; civil servants considered for promotion are considered to meet the standards and conditions of the considered rank;
