Pursuant to Section 1.1, Sub-section 1, Section III of Official Dispatch 2529/SNV-SBN in 2025, the implementation procedures for cases of voluntary early retirement or resignation from work are clearly stated:
Based on the voluntary application for early retirement or resignation from work of cadres, civil servants, public employees, cadres, civil servants at the commune level, workers, agencies, organizations, and units considering implementation as follows:
Step 1: Heads of departments, Heads of units/departments under agencies, organizations, and units consider cases under their management authority that have submitted voluntary applications for early retirement or resignation, collect opinions from the Party Committee at the same level and report to the agency advising on the work of organizing cadres at the same level, according to the management decentralization.
Step 2: The agency/department advises on the organization of cadres to compile a list and estimate the cost of early retirement and resignation, and report to the head of the agency, organization, or unit.
Step 3: The head of the agency, organization, or unit, together with the Party Committee and the government at the same level, reviews and evaluates according to criterion 12 and specifically resolves each case. In case of no agreement to resolve the issue, the agency, organization or unit must respond in writing and state the reason.
The priority order for consideration, evaluation and resolution is as follows:
(1) Cadres, civil servants, public employees, and workers are in poor health and do not meet job requirements.
(2) Cadres, civil servants, public employees, and workers after the restructuring of the apparatus and the restructuring of administrative units have not met the training standards; professional degrees have not met the job position requirements approved by competent authorities.
(3) Cadres, civil servants, public employees, and workers with less than 10 years of service until the retirement age according to regulations.
Step 4: Agencies, organizations, and units that appraise, compile documents, lists, and budget estimates for eligible cases and have a voluntary application for early retirement or resignation shall submit to the Department of Home Affairs for compilation, appraisal and reporting to competent authorities for approval.
Step 5: The Department of Home Affairs synthesizes, appraises the dossier and has a Document to consult the Department of Finance on reviewing and appraising funds and funding sources for implementing policies and regimes.
Step 6: Based on the opinion of the Department of Finance, the Department of Home Affairs synthesizes and submits to the City People's Committee for consideration and approval of the list and budget.
Step 7: After having the approval decision of the City People's Committee, the agencies and units shall pay policies and regimes to cadres, civil servants, public employees and workers in accordance with the provisions of law.
In particular, for cadres, civil servants and public employees under the management of the City Party Committee Standing Committee, the implementation is according to the cadre work process of the City Party Committee and the City People's Committee.
