Youme Law Firm LLC said that, based on Clause 1, Article 35 of the Law on Officers of the Vietnam People's Army 1999, amended by Clause 11, Article 1 of the Law on Officers of the Vietnam People's Army amended in 2008, military officers are exempted from military service in the following cases:
- Meeting retirement conditions;
- Expired the prescribed age of active service;
- Due to changes in organization and staffing, there is no longer a need to arrange professional military officers and defense civil servants;
- No longer meets the prescribed standards for officers in active service.

Pursuant to Article 1 of the 1999 Vietnam People's Army Officers 'Law amended by Clause 1, Article 1 of the Vietnam People's Army Officers' Law amended 2008 stipulates that the Vietnam People's Army Officers are officials of the Communist Party of Vietnam and the Socialist Republic of Vietnam, operating in the military field, which is promoted to the military rank of a rank of lieutenant, level and general level.
Officers are the core force of the army and are the main component of the military staff, holding leadership, command, management positions or directly performing a number of other tasks, ensuring the army is ready to fight and completing all assigned tasks.
People's Army officers are divided into two ranks:
