Reporting to the Ministry of Home Affairs, Mr. Nguyen Van Truong (name has been changed) represents a number of teachers working in extremely difficult areas of Thanh Hoa province under Decision 582 until the end of December 2020.
From January to May 2021, the Government issued Decision No. 72 on extending Decision 582 until a new decision is issued. After that, the Government issued Decision 861, the commune where they worked continued to be a particularly difficult commune.
However, Quan Son District People's Committee has collected their benefits from January to May 2021 because Decision 861 took effect from June 2021, so the policies for those working in extremely difficult areas can only be enjoyed from June 2021.
Mr. Truong said that the response of the People's Committee of Quan Son district, Thanh Hoa province is not satisfactory.
"Why are only commune-level civil servants and teachers working in that area subject to retrospective collection while border guards and commune-level police are not subject to retrospective collection?" - Mr. Truong wondered.
Regarding Mr. Truong's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.
In Clause 2, Article 1 of Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government on policies for cadres, civil servants, public employees, workers and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions; including communes in region III in ethnic minority and mountainous areas, and island communes with special difficulties according to the decision of the Prime Minister.
Article 1 of Decision 72 stipulates: Communes and villages approved in Decision No. 582/QD-TTg dated April 28, 2017 shall continue to enjoy social security policies issued from January 1, 2021 until the Decision approving the List of extremely disadvantaged villages and communes in Region III in ethnic minority and mountainous areas for the period 2021-2025 by competent authorities is issued and takes effect.
Decision No. 582/QD-TTg dated April 28, 2017; Decision No. 861/QD-TTg dated June 4, 2021 and Decision 72/QD-TTg dated January 16, 2021 were chaired by the Minister and Chairman of the Ethnic Committee and submitted to the Prime Minister for promulgation.
The Ministry of Home Affairs requested Mr. Truong to send a document to the Ethnic Committee for consideration and response according to authority.
