Ms. Luong Thi Le (character's name has been changed) said that she is currently working as a clerical position at a kindergarten in Thai Nguyen province. She graduated from college with a major in documentaries and archives in October 2011.
According to the presentation, since October 2012, she has been a contract clerical worker, receiving a college degree salary and participating in compulsory social insurance. In December 2016, she was recruited to the payroll, but was ranked 2nd in the intermediate clerical position, code 01.008.
From the actual work, Ms. Le made two recommendations.
First, she wondered whether when she was a contract employee receiving a college salary, after being recruited, her average salary was classified as correct according to regulations, and at the same time, whether her case was eligible for review and salary rearrangement according to current regulations.
Second, with the current salary of grade 7 of the intermediate clerical ( type B civil servant) rank considered too low compared to 13 years of work, she hopes to be considered for appointment to the cadre rank (code 01.004, civil servant type A0) in accordance with her college training level.
She suggested clarifying the conditions and procedures that need to be implemented, as well as the time when the promotion for school staff can be organized according to regulations.
Regarding Ms. Le's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
The Ministry of Home Affairs said that, based on the provisions of Article 65, Article 66 of Decree No. 115/2020/ND-CP of the Government, (amended and supplemented in Decree No. 85/2023/ND-CP), the duties and powers of the People's Committees of provinces and centrally run cities are clearly stated:
Management of the number, standards, recruitment and use of civil servants under the management scope according to assignment and decentralization; decision to appoint and classify salary for professional titles of class I after reaching consensus of the Ministry of Home Affairs; decision to regularly raise salary levels, raise salary levels ahead of schedule for civil servants holding professional titles of class I; decision or decentralization of the decision to appoint professional titles, salary classification, salary increase and seniority allowance beyond the framework for civil servants holding professional titles of class II or lower under management.
Decentralization of recruitment, use, training, and fostering of civil servants in public service units under the management authority.
Decide on the list of job positions, the structure of civil servants according to professional titles and the number of employees according to assignments, decentralization and according to the regulations of the Party and the law.
The People's Committees of provinces and centrally run cities also have the task of organizing exams or considering promotion of second-class professional titles for civil servants under their management according to the instructions of the Ministry of Home Affairs and the Ministry of specialized civil servant professional title management.
Organize or decentralize, authorize the organization of exams or consider promotion of professional titles of Grade III and Grade IV for civil servants under the management scope.
The Ministry of Home Affairs recommends that Ms. Le discuss with the civil servant management agency where she works for guidance and resolution.
