On April 25, the National Assembly Standing Committee commented on the Law on amending and supplementing a number of articles of the Bidding Law, the Law on Investment in the form of public -private partnership, Customs Law, Export Tax Law, Import Tax, Law on Investment, Public Investment Law, Law on Management and Use of Public Assets.
Presenting a summary of the Law Project, Minister of Finance Nguyen Van Thang said that in the face of changes in the socio-economic situation, legal documents on investment, finance, and budget have arisen some difficulties and problems in the implementation process, so they need to be reviewed and studied for amendment and supplementation.
Accordingly, the Government has urgently reviewed, summarized and evaluated the implementation of Laws in the fields of investment, finance, and budget and identified 7 Laws that need to be amended and supplemented appropriately to implement the arrangement and organization of the local government apparatus, creating motivation to contribute to promoting the development of science, technology, innovation, national digital transformation, and promoting economic growth.
Regarding the scope of regulation and draft law amending and supplementing a number of articles of the current 7 laws, including: Bidding Law; Law on Investment by the method of public -private partnership; Customs Law; Law on Export and Import Tax; Investment Law; Law on Public Investment; Law on management and use of public assets.
In particular, regarding the content of amending and supplementing a number of articles of the Law on Bidding, the draft Law amends regulations on: Priority and incentive policies in bidding to support the development of science and technology, innovation, digital transformation; bidding activities of state-owned enterprises and public service units; adding regulations on domestic bidding and international bidding;
At the same time, supplement and expand the cases of applying the form of bidding and selecting contractors and investors in special cases for packages and projects that need to ensure national interests or have specific requirements for research, application and development of science and technology.
Regarding the content of amending and supplementing a number of articles of the Law on Management and Use of Public Assets, the draft Law amends regulations related to the management and use of assets formed through the implementation of scientific and technological tasks.
Remove regulations on management and use of assets formed through the implementation of scientific and technological tasks using state capital; abolish some phrases to ensure consistency and unity with the content and scope of regulation of the Law; amend the contents on the arrangement and organization of the apparatus, promote decentralization and delegation of power.
Summarizing the report of the Law on the Law, the Standing Vice Chairman of the Economic and Finance Committee Le Quang Manh said that the Committee basically agreed on the need and the scope of amendments and supplements to the laws according to the Government's report. Basic law project dossier meets the requirements of the Law on Promulgation of Legal Documents for the shortened procedure process.
However, the Economic and Financial Committee recommends that the Government report an explanation and supplement the assessment of policy impacts so that the National Assembly Standing Committee and the National Assembly have a basis for consideration and decision.
Regarding specific contents, Mr. Le Quang Manh noted that the drafting agency should continue to closely coordinate with relevant ministries and agencies to review and ensure consistency between relevant laws, new terms on science, technology... and transitional provisions to ensure consistency.
