I. RESULTS OF IMPLEMENTATION OF THE PARTY'S CHARTER

The 11th National Party Congress (January 2011) approved documents, including the Party Charter (supplemented and amended); the 12th and 13th National Party Congresses[1] (in 2016, 2021) agreed to keep the current Party Charter. Immediately after the 11th Congress, the Secretariat held a national conference to disseminate the documents approved by the Congress. The Party's advisory and supporting agencies at the Central level have proactively guided the organization of studying and disseminating documents throughout the Party; compiled and provided documents, outlines, and sent cadres with experience in Party building work to help Party committees at all levels organize studying and disseminating at key cadre conferences. Party committees at all levels have developed plans and organized conferences to study and disseminate the Party Charter, regulations and instructions of the Central Committee on the implementation of the Party Charter. The work of disseminating and disseminating the Party Charter, regulations and instructions of the Central Government has been carried out in many rich and diverse forms2, focusing on clarifying new points in the Party Charter. 1.1. Regarding concretization
The 11th National Party Congress approved the Party Charter with a number of supplements and amendments to meet the requirements and tasks of the revolution in the new period and in line with the National Construction Guidelines in the period of transition to socialism (supplemented and developed in 2011). The 12th and 13th Congresses of the Party assigned the Central Executive Committee, the Politburo, and the Secretariat to direct the study and acceptance of the Congress's opinions to adjust the problems and shortcomings through the Central's regulations and instructions on the implementation of the Party Charter.
At the 3rd Central Conference of the XI and XII terms, the Central Executive Committee issued regulations on the implementation of the Party Charter, specifically for the 13th Congress term, to create a political and legal basis for implementing the revolution in streamlining the organizational structure and supplementing and amending a number of contents to suit the reality of Party building work in the new situation. The Central Executive Committee has issued regulations implementing the Party Charter three times; 03 times regulations on inspection, supervision and discipline of the Party were issued; The Central Executive Committee has decided to direct the piloting of a number of new policies[3]; The Secretariat twice issued instructions on a number of specific issues implementing the Party Charter. Based on the practical situation of Party building work, the Central Committee has reviewed, promulgated, supplemented and amended many regulations and guidelines to concretize the Party Charter, meet the requirements of Party building and rectification work, and strengthen the Party's leadership role with the State and society, focusing on areas such as: party members and party member work; democratic centralism; functions, tasks, powers, organizational structure, working relationships and sample working regulations of organizations; about elections within the Party; term, delegates, congress presidium; Party committee level and new term committee member level; tasks of the congress and delegates to the party congress; number of party committee members, standing committee members, and inspection committee members at party level; grassroots party organizations and party cells; Party organizations in the Vietnam People's Army and the Vietnam People's Police; inspection, supervision, and disciplinary work of the party and inspection committees at all levels; reward party organizations and party members; on staff work and staff management; Youth Union; Party finances; on the application of science and technology, digital transformation, administrative reform in the Party... The Central regulations and instructions have been promptly supplemented, amended, and synchronized with newly issued Party documents, resolving problems that arise in practice and problems and inadequacies in the implementation of the Party Charter, especially issues of organization, cadres, party members, inspection, supervision, rewards, and party discipline.
Central advisory and supporting agencies have proactively and actively researched and coordinated with relevant Party committees, Party organizations and agencies to summarize and summarize practical developments, promptly guide Party committees and organizations on professional skills in the process of implementing the Party Charter, such as Party members and Party members' work, transferring Party activities, transferring Party organizations, evaluating and classifying Party members, Party inspection, supervision and Party discipline; advising the Party committees to strengthen leadership, direction, guidance, inspection and supervision of Party building work and mass work in the Vietnam People's Army and the Vietnam People's Public Security.
Party committees and organizations at all levels have actively and proactively concretized[4] a number of contents of the Party Charter, regulations and guidance of the Central Government, especially the contents of the framework and principles in accordance with the characteristics, situation and conditions of the locality and unit. At the same time, proactively issue documents to resolve difficulties and problems arising in practice, boldly innovate, pilot good models and creative ways of implementing the Party Charter.
In general, the policies, resolutions, regulations, and instructions of the Central Executive Committee, the Politburo, the Secretariat, central advisory and support agencies, Party committees and organizations issued to specify the Party Charter are basically suitable to the practical situation, ensuring comprehensiveness, synchronization, unity, feasibility, and increasingly clear content, making it more convenient for Party committees, Party organizations, cadres and Party members to implement.
However, some contents in the regulations and instructions of the Central Government are still highly general, not fully covering the subjects and difficulties in implementing[5], the concretization of some regulations is not yet timely.
1.3. Regarding inspection and supervision
The inspection and supervision of the dissemination and implementation of the Party Charter, regulations and instructions of the Central Government have been of interest to the Party committees, advisory agencies, and inspection committees at the Party committees[6]; At the end of the Central Committee term, the Party committees at all levels have conducted inspection work associated with the summary of the implementation of the Party Charter[7], ensuring the Party Charter is widely disseminated, thoroughly disseminated, strictly and consistently implemented throughout the Party.

However, some new contents of the National Construction Area in the Transitional period to Socialism (Supplemented and developed in 2011), the Constitution of the Socialist Republic of Vietnam and documents issued during the 11th, 12th and 13th Party Congresses on Party building and political system building have not been updated or supplemented in the Party Charter[8].
2.2 About Party members (Chong I)
The duties of party members stipulated in the Party Charter are strictly followed by most Party committees, organizations and party members. Party committees and organizations have implemented the regime of assigning members to monitor and supervise lower-level party organizations, directly attending Party cell activities; assigning tasks in accordance with the capacity of Party members and the specific conditions of each Party cell; many Party cells in residential areas have assigned Party members to monitor and supervise households, raising awareness of responsibility, pioneering and exemplary role of Party members in performing tasks, strengthening management and evaluating Party members more closely and accurately.
The rights of Party members are of interest to most Party committees and organizations at all levels, implemented in accordance with the provisions of the Party Charter and the regulations and rules of the Central Committee and Party committees at all levels. From the beginning of the 11th Congress term to May 2025, the entire Party has admitted 2,623,209 Party members. Many provincial Party Committees, city Party Committees, and party committees directly under the Central Government have increased the rate of party membership. The basic standards, conditions, processes and procedures for admitting party members are strictly followed; the admission of people to the Party and admitting party members in some special cases are carefully and objectively considered by committees at all levels[10]. Most newly admitted Party members have the will to practice well, strictly comply with the Political didoms, Party Charter, Resolutions and directives of the Party, policies and laws of the State; maintain the qualities, ethics and lifestyle, have a good awareness of striving to fulfill assigned tasks, promote their pioneering and exemplary roles, take the lead in activities at the grassroots level and be considered and recognized as Party members according to the prescribed procedures, processes and times. The removal of party members' names and removal of party members from the Party has been seriously implemented, ensuring the maintenance of Party discipline[11].
As of May 31, 2025, the entire Party has 5,558,731 Party members; the Party member structure has changed positively, the proportion of young Party members, women, ethnic minorities, and religious people is increasing[12]. The management of party member cards still has some limitations, basically cannot revoke party cards according to regulations for expelled party members, many party members have lost party cards; some Party member records management committees are not strict, and the documents in the records are not complete according to regulations. Some Party cells have reduced or exempted Party work and activities in the form of old age and weakness, which is not in accordance with reality and conditions. Some party members have not performed their party membership duties well; arbitrarily do not submit party membership documents to new workplaces; when working abroad, they are late or do not change party activities according to regulations.
Guidelines on the age of admitted party members have different understandings, confusing in implementation[16]. Some contents on introducing party activities and party activities are temporarily not close to the practical situation, especially for party members who often work away from the official party scene, students who do not have jobs or stable housing after graduation.
2.3. On the principles of organization and organizational structure of the Party (Chuong II)
The regulations on the Communist Party of Vietnam organized according to the principle of democratic centralism are strictly implemented. Regulations on the Party's organizational system are established in accordance with the State's administrative organizational system, which is basically strictly implemented and unified nationwide; synchronously implement the arrangement of the Party organization with the arrangement of 02-level administrative units and villages and residential groups, ensuring the continuous and comprehensive leadership of the Party Committee level for the activities of localities, agencies and units before, during and after the arrangement. From 01/7/2025, the entire Party has 34 Party Committees of provinces and centrally run cities; 3,321 Party Committees of communes, wards and special zones.
Most grassroots party organizations at administrative, career, economic or working units are under the leadership of commune, ward and special zone committees under provinces and centrally run cities; some grassroots party organizations at agencies and units are organized in areas under the leadership of vertical party organizations in localities[17], ensuring the leadership and direction role of Party committees and organizations at all levels for agencies and units.
The establishment and termination of the activities of the Party Committees of the blocs and Party Committees in places with their own characteristics under the Central Government, under the Provincial Party Committees and the Party Committees and Party Cell under the Central Government are implemented consistently according to the regulations; up to now, the Central Government has decided to end the activities of 02 Party Committees of the blocs at the Central level and basically end the activities of the Party Committees of the blocs at the provincial level, establish 04 Party Committees under the Central Government[18], 02 Party Committees under the Provincial Party Committees and City Party Committees[19], 02 Party Committees under the Party Committees of communes, wards and special zones[20]. The Party's election regulations and the instructions of the Secretariat have been led, directed and organized by Party committees, Party organizations and Party members at all levels to be seriously and effectively implemented. Principles and forms of election; powers and responsibilities of individuals and organizations related to elections; candidations, nominations, regulations on balance, order, and election procedures in accordance with the actual situation. The Politburo's directives on Party congresses at all levels towards the National Party Congress, the Politburo's regulations on standards for cadres and Party members are clearly regulated, contributing to the effective implementation of the consolidation of leadership agencies and building a team of Party committee members at all levels to ensure standards, structure, quality, and meet requirements and tasks.
The system of specialized agencies advising, assisting, and public service units of the Central and Party Committees continues to be arranged, consolidated, and innovated in the direction of improving the effectiveness and efficiency of operations, streamlining staff, streamlining internal focal points, reducing the number of management leaders; functions, tasks, powers, responsibilities, and working relationships are reviewed, supplemented, amended, and regulated more clearly.
To advise and assist the Party Committee in implementing and performing a number of tasks in leadership and direction, the Party Committees at all levels have established subcommittees[21], councils[22], working groups, steering committees[23] and dissolved them upon completion of their tasks.
In general, the regulations on the principles of organization and organizational structure of the Party in the Party Charter are suitable, the implementation process is smooth, the principle of democratic centralism, regulations on terms of office, delegations, congress presidium, and newly appointed Party committees and Party committee members are basically strictly implemented; all types of Party organizations have promoted positive effectiveness in performing functions and tasks according to regulations, basically leading the implementation of assigned political tasks well; the organization of the Party apparatus at all levels has been arranged, innovated, and perfected in the direction of streamlining, operating more effectively and efficiently.
Limitedness, problems, inadequacies: The concretization of the principle of democratic centralism is still scattered in many documents, not systematic, therefore, the awareness of the principle of democratic centralism is not unified and not complete. Some Party committees and organizations have not strictly implemented the principle of democratic centralism, limiting debate and discussion in Party activities, and in some places, there are even serious violations. In the activities of the Party Committee and Party cell, self-criticism and criticism are sometimes not practical, not regular, and the situation of being afraid of conflicts, avoiding and being afraid of collisions still occurs in many places. Some Party Committee members and Party members have not yet grasped and strictly followed the Party Charter, regulations and instructions of the Central Committee, violated the principles of Party organization and activities; have not fully fulfilled their responsibilities, obligations and powers of Party Committee members and Party members[24]. The development of working regulations at some Party committees and organizations has not focused on content and principles, has not specified tasks and authority close to localities, agencies and units; in some places, the issuance is slow, the quality of regulations is not guaranteed; in some places, the implementation of working regulations is not serious. Some model of party organization implemented by localities and pilot units[25] are not synchronous, unified, ineffective, and not in accordance with the regulations on the implementation of the Party Charter, which must end operations. The model of the Party Committee of the Central and Provincial Party Committees still has many limitations and shortcomings (which has ended its operation since January 24, 2025).
2.4. Party leadership agencies at the central level ( ruling III)
During each term, the Central Executive Committee has developed a full-term work program[26], setting out major and important tasks to focus on comprehensive and synchronous leadership and direction in all aspects of work; the Central Executive Committee basically implements the set program and makes timely adjustments to meet the requirements of leadership and direction, in accordance with the country's situation. The working regulations of the Central Executive Committee, Politburo, and Secretariat for each term[27] have inherited the appropriate contents of the previous term, supplemented a number of new contents to meet practical requirements, clearly and specifically defined the tasks, powers, responsibilities, and working routes of the Party's senior leadership agencies and were strictly implemented. The Central Executive Committee, the Politburo and the Secretariat uphold the principle of democratic centralism in their activities, always be united and highly unified in their decisions, especially on new, difficult, sensitive and complicated issues, contributing to decision-making and ensuring the maintenance and strengthening of the Party's leadership role towards the State and society.
The Central Executive Committee, the Politburo and the Secretariat have truly upheld their responsibility, promoted democracy and collective intelligence in concretizing the Resolutions of the 11th, 12th and 13th Congresses into resolutions, conclusions, directives, regulations, regulations[28] and effectively led and directed the implementation throughout the Party.
The Politburo members, Secretariat members, Central Executive Committee members and especially the General Secretary spent time working directly with the Party committees and affiliated Party organizations, inspecting and learning about the actual situation at the grassroots level. The Standing Secretariat and the Party's central advisory agencies have increased regular meetings with Party committees, Party organizations, agencies and units at the central and local levels to grasp the situation and direct the coordination in handling newly arising issues.
In general, the regulations on the National Congress of Delegates, the Central Executive Committee, the Politburo, the Secretariat and the functions, tasks and powers of each Party leadership agency at the Central level are appropriate and effective in leading, directing, inspecting and supervising the implementation of the Political Conduct, the Party Charter, the resolutions of the Congress; policies and strategies on economy, society, national defense, security, foreign affairs, Party building work and piloting a number of new policies, on coordination of activities between organizations in the political system.
2.5. Party leadership agencies at all levels (Chuong IV)
Committees at all levels have focused on leading, directing, and properly implementing the Party Charter, regulations and instructions of the Central Government on the content and tasks of congresses and delegates attending party congresses; on the number of members, members of the Standing Committee, members of the Inspection Committee at the Party Committee level; on the duties and powers of the Executive Committee, Standing Committee, Standing Committee at the Party Committee level, secretary, deputy secretary of the Party Committee at the provincial and district levels (from July 1, 2025, the commune, ward, and special zone will be considered).
Local Party leadership agencies are focused on building and perfecting strongly. Most standing committees and boards have properly performed their functions, tasks, and working regulations, continuing to innovate content and forms of life in a practical and effective manner; leading, directing, discussing, and deciding on issues within their authority, demonstrating the leadership role of the Party in the locality; clearly assigning tasks to each committee member and member of the standing committee at the committee level. The superior committee regularly inspects and supervises the subordinate committee in developing and implementing working regulations to promptly rectify contents that are not in accordance with the provisions of the Party Charter, the Central Committee and the State's laws, and overcome limitations in the implementation process.
The appointment of Party committees and the addition of directions and tasks for newly established, merged, merged and separated Party organizations are carried out seriously, promptly and synchronously, especially in places where administrative unit arrangement, organizational arrangement of agencies and units are carried out, ensuring that Party organizations and Party committees operate continuously, maintain their leadership role and do not have to organize congresses many times.
In general, the regulations on Party leadership agencies at all levels in the Party Charter are strictly implemented, contributing to improving the role, effectiveness and efficiency of the activities of Party committees at all levels in leading, directing, inspecting and supervising the implementation of the Political Conduct, the Party Charter, the resolutions of the congress, policies and guidelines on economy, society, national defense, security, foreign affairs, Party building work, building the political system and organizing the pilot implementation of a number of new policies in the locality.
Limitedness, problems, and inadequacies: The performance of the duties and powers of the standing committee, especially the working relationship between the committee's secretary and the chairman of the People's Committee, is still confusing in some places. Chapter IV regulating Party leadership agencies at all levels does not stipulate that commune Party committees are leadership agencies at the commune level.
2.6. On grassroots party organization (Chong V)
As of May 31, 2025, the entire Party has 49,733 Party committees and grassroots Party cells[29], 2,633 Party departments and branches, 235,694 subordinate Party cells. The establishment of grassroots party organizations, departmental and party cells under the Party must comply with the Party Charter, regulations and instructions of the Central Government.
Party committees and organizations have led, directed, and implemented seriously, methodically, and effectively the provisions of the Party Charter, the Central's policies, resolutions, regulations, and guidelines on: building grassroots party organizations; functions and tasks of all types of grassroots party organizations; building party organizations in non-state enterprises; innovating the content and forms of party cell activities; especially, since implementing the model of local government at 02 levels, the Party committees of communes, wards, and special zones have focused on leading, directing, and advising on the completion of the work of perfecting the organization and arrangement of cadres; agencies, units, and organizations operating smoothly, close to the people, closely following the people, basically meeting the requirements of modern social governance. The majority of grassroots party organizations have promoted their role as the political core at the grassroots level, leading cadres, party members and people to successfully complete the political tasks of localities, agencies and units according to the functions and tasks prescribed by the Party and Central Charter.
The work of evaluating and classifying the quality of grassroots party organizations every year has been seriously organized by Party committees and organizations in accordance with the regulations and instructions of the Central Government, gradually overcoming the disease with achievements and more substantial results.

There are no specific regulations for grassroots party committees, grassroots party committees, and party committees that are authorized to pilot the delegation of power to grassroots levels after establishment without maintaining the required number of party members. The 05-year term of the Party cell under the grassroots Party Committee has not been consistent with the term of the congress of the superior level and the regulations on personnel work, difficulties in determining the political tasks of the term and the work of personnel arrangement (before July 1, 2025). Regulations on the establishment of grassroots party organizations including grassroots party committees and grassroots party cells[31] are not close to reality in terms of scale, nature and tasks of each type of party organization. In reality, there are many types of grassroots Party committees and Party cells with different functions and tasks, but the Party Charter only stipulates the general tasks of grassroots Party organizations that are not in accordance with reality (the Secretariat has issued functions and tasks for each type of grassroots Party organization). There are no specific regulations on the conditions for establishing grassroots Party cells and affiliated Party cells; on the functions and tasks of the Party Committee of the department. practice shows that regulations on grassroots party organizations still have many issues that need to be carefully studied to be amended and replaced to suit the overall model of the apparatus in the new period.
2.7. On Party organization in the Vietnam People's Army and the Vietnam People's Public Security (Chuong VI)
New regulations of the Politburo, the Secretariat on Party organization in the Vietnam People's Army and the Vietnam People's Public Security, and political agencies in the Vietnam People's Army are supplemented, amended, and issued promptly, in line with the streamlining of the organization of the Vietnam People's Army and the Vietnam People's Public Security, contributing to the rapid completion of the Party organization system in the Army and the Public Security[32] The leadership position and role of the Party organization in the Army and Police are increasingly affirmed and strengthened; the functions and tasks of all types of Party committees and Party cells in the Army and Police are reviewed, supplemented and amended; the functions and tasks of the Party Committees in the Army and Police are more clearly defined, contributing to removing difficulties and obstacles.
Strictly implement the regulation that the secretary of the provincial and municipal Party Committee participates in the Party Committee of the military region; the secretary of the provincial and district Party Committee (from July 1, 2025 to commune, ward, and special zone) is the secretary of the military Party Committee of the same level; the deputy secretary of the provincial and municipal Party Committee in charge of the Border Guard Party Committee (before July 1, 2025); the deputy secretary is the chairman of the People's Committee in charge of the Party Committee of the police at the same level; the military party organization, local police at each level is under the direct leadership in all aspects of the local police at that level, and at the same time complies with the resolution of the military party committee, the superior police party committee in terms of expertise and profession; the regulation on coordination between the police at the above level and the lower level in the leadership, direction of the local police at the same level, affirming the role and responsibility of the local police at the same level, but in accordance with the role and organization of the local police at the same level, the role and the national defense at the same level, the role and the national defense at the same level in the national defense and public security at the same level.

Limitations: The structure of military agencies participating in local Party committees is not suitable[34]; the completion of the presiding staff at provincial military agencies[35] participating in local Party committees in some places is still slow (before July 1, 2025).
2.8. On inspection and supervision work of the Party and inspection committees at all levels (Chuong VII)

Advisory and supporting agencies have closely followed the direction of the assigned Party Committee, functions, tasks, and authority, initially carried out well the inspection and supervision of lower-level Party committees and organizations in complying with the Party's guidelines, resolutions, regulations, the State's policies and laws, etc., rectify shortcomings and defects in principles, procedures, processes, working regimes, and transfer to the Inspection Committee for a number of cases when Party organizations and Party members show signs of violations.
In general, the regulations on inspection and supervision work of the Party and inspection committees at all levels in the Party Charter, the regulations and instructions of the Central Committee are basically appropriate, synchronous, unified and implemented resolutely and methodically, gradually becoming more disciplined, quality and efficiency are improved, with breakthroughs with clear and specific results; Along with that, the inspection committees at the higher levels guide and direct the Party committees, Party organizations, and inspection committees at lower levels in inspection, supervision and discipline work of the Party, contributing to helping Party committees, Party organizations, and Party members strictly comply with the Political Conduct, Party Charter, resolutions, directives, regulations, organizational principles of the Party, State laws; building a strong and strong Party leadership, strengthening the Party organization, strengthening the Party's leadership, and strengthening the Party's leadership, thereby continuing to strengthen the Party's role. (ii) Difficulties for the Party organization, when a Party member is removed from his or her position in the Party, if there are complaints, the competent authority will reduce or eliminate discipline, the issue of restoring the position, rights and honor for that Party member will be difficult to resolve; the psychological problem of complaining "asking for luck" until the complaint is exhausted due to the implementation of the procedures from the inspection committee to the standing committee, the Party Committee level to the Central Executive Committee. (iii) Difficulties in establishing new party organizations or introducing party activities to party members when the party organization is disciplined and dissolved; implementation of recording party member resumes for the party organization that has been disciplined and dissolved. The term for election to the Party Committee and appointment to positions equivalent to or higher for party members disciplined by dismissal is one year according to Clause 3, Article 40, Party Charter, which needs to be amended to suit the reality of the regulations currently in effect during the 13th term. (iv) Regarding the working regime of the inspection committee and the inspection committee agency: the relationship, innovation to have relatively independence between the inspection committee and the committee at the same level. The issue of ensuring compliance with the principle of democratic centralism when the superior inspection committee has a different opinion from the committee or standing committee of the inferior committee. The work of inspecting party finances for subordinate party organizations, financial agencies at the same level and the implementation of inspection and supervision tasks of a number of inspection committees, advisory and support agencies of the Party Committee, especially at the district level, is still limited; the work of inspecting and supervising the Party's enterprises has not received due attention[37]. Some corporate party committees in the Army have not yet arranged full-time inspectors according to regulations.
Regulations on subjects and contents of inspection and supervision; on complaints and complaints about party discipline of party members; on the authority to discipline of Party cells have broader content, some contents are not suitable for practice. It is not yet specified the authority to conclude inspections and supervisions assigned by the Party Committee to specialized agencies to advise and assist the Party Committee in conducting inspections.
September 2. On reward and discipline (Article VIII)

The addition of the regulation on awarding the 45-year Party membership badge, considering awarding early, posthumously, and not being considered for awarding the Party membership badge to party members is appropriate, meeting the wishes of party members, and achieving consensus and unity in the Party.
Basically, Party committees at all levels strictly implement the Party Charter, regulations and instructions of the Central Committee on disciplining Party organizations and Party members who violate. The complaints of party organizations and party members and the settlement of party discipline complaints have been carefully and objectively implemented by Party committees and inspection committees at all levels; the disciplinary action against party organizations and party members who violate the law has been carried out promptly, strictly, in accordance with authority and procedures, ensuring principles, directions and motto in disciplinary action. Disciplining the dissolvement of party organizations, suspending party activities of party members and suspending the activities of Party committees at the Party Committee level, suspending the activities of Party organizations, disciplining Party members and Party committee members who violate the law who are prosecuted, temporarily detained, or sentenced are strictly regulated by the Central Committee on procedures and authority; the Party committees at all levels are very cautious and strictly implemented[39].
In general, the regulations on rewards and discipline in the Party Charter, regulations and instructions of the Central Government are appropriate, implemented consistently, the implementation results contribute to tightening discipline and order in the Party, promoting the law of the State, and are highly appreciated by many cadres, party members and people.
Limitations, problems, and inadequacies: The implementation of regulations on disciplining party organizations and party members in some party organizations has not been serious, with phenomena of being lenient, avoiding, and localized; some cases are not in accordance with principles, procedures, and authority. Some party members take advantage of their right to complain and denounce to cause disunity, negatively affect the honor and reputation of party members and party organizations, and violate regulations on what party members are not allowed to do.
Regulations on gift value accompanied by forms of reward are not similar to State regulations. Regulations on the authority and form of commendation of provincial Party committees and direct superiors of grassroots Party organizations for Party organizations and Party members with the same achievements in completing tasks excellently for 05 consecutive years have not been agreed upon[40]. Regulations on the disciplinary period of the Party and the State have not been synchronized[41]. Some regulations on the time for arranging and using cadres and party members after being disciplined are still inadequate.
2.10. Party leadership, State Front and socio-political organizations (Chuong IX)
Party organizations and Party members working in state agencies, the Fatherland Front and socio-political organizations from the Central to the grassroots level have basically performed well their assigned tasks and powers, maintained working principles and living regimes according to the Party Charter, regulations and guidance of the Central Committee and working regulations, focused on leading and directing the concretization and institutionalization of the National Building Area during the period of transition to socialism (supplemented and developed in 2011), Resolutions of the National Congress of the National Assembly, strategies and plans for socio-economic development issued by the 11th, 12th and 13th Congresses of the Party, policies, resolutions, directives and regulations of the Party, into legal documents, regulations, regulations, strategies and management plans of each agency, mobilization and implementation of resources and focused on implementation. Regulate and strictly implement the establishment and termination of the activities of party delegations and party executive committees at the central and provincial levels; establish and promulgate regulations on the functions and tasks of the Government Party Committee, National Assembly Party Committee, Fatherland Front Party Committee, Central organizations; Party committees in ministries, ministerial-level agencies, agencies under the Government, National Assembly agencies, socio-political organizations and mass organizations assigned by the Party and State to ensure leadership role and unity, synchronization with the arrangement of new organizational models; establish Party committees of Party agencies, Party committees of People's Committees at the provincial and commune levels. The establishment of Party committees and Party cells in agencies and organizations where the activities of Party delegations and Party executive committees at the central and provincial levels end ensure the leadership of the Party in the State's leadership agencies, the Fatherland Front, socio-political organizations, central-level executive and judicial agencies and the provincial and centrally run city levels; the establishment of Party groups at the Standing Committee of the Ethnic Council, standing Standing Committees of the National Assembly Committees, National Assembly delegations; Party groups at the National Assembly delegations (operating at National Assembly sessions) have ensured and strengthened the comprehensive leadership role of the Central Executive Committee, Politburo, Secretariat for the Government, National Assembly, Fatherland Front, Central and provincial-level mass organizations, socialist Party committees for national government agencies, provincial and socialist Party organizations, Party delegations at the provincial and socialist levels. In general, the regulation on the Party leading the State, the Fatherland Front and socio-political organizations is appropriate. Party organizations and Party members working in state agencies, the Fatherland Front and socio-political organizations basically strictly comply with the Party's resolutions and directives.
Limitedness, problems, inadequacies: The organizational and operational model of the Party Executive Committee and Party Delegation is still limited and inadequate. The implementation of the leadership of the inspection work of the Party Delegation and the Party Executive Committee is still limited. The coordination between the Party delegation, Party executive committee and Party Committee, collective leadership and heads of agencies and units in some places is still confusing and not strict. The model of party delegations and party executive committees has not been fully promoted in the tasks and powers; some places have not implemented the principle of democratic centralism and working regulations (before January 24, 2025). Regulations and instructions on the organization and operation of party groups in the Ethnic Council and the National Assembly Committees, National Assembly delegations are not complete.
2.11. Party leadership of Ho Chi Minh Communist Youth Union (Chong X)
Party committees and delegations at all levels have strictly implemented the provisions of the Party Charter on the Ho Chi Minh Communist Youth Union. The youth union has truly been a reliable reserve team of the Party, regularly adding a young force to the Party, continuing to follow the glorious revolutionary career of the Party and President Ho Chi Minh[42]; being the core force in the youth movement; at the same time, being a socialist school, representing the rights of the youth and in charge of the Ho Chi Minh Front Youth Union continuing to develop.
Party members who are still of union age still live and work in the union organization in accordance with regulations and are active factors in building the union organization, examples for young union members to learn from, follow the example to strive for the Party; at the same time, uphold the responsibility of young party members towards the union organization.
Party committees and organizations at all levels have regularly paid attention to and directly led the Youth Union in determining the direction, political tasks, ideological work, organization and cadres. The Ho Chi Minh Communist Youth Union has focused on improving the quality of propaganda and education for union members and young people, creating an environment for union members and young people to practice, challenge, and contribute; creating conditions for union members and young people to promote their pioneering and creative roles, strive to study, work and life, enthusiastically participate in community activities, actively participate in building localities, agencies and units.
In general, the Party Charter and regulations of the Central Committee determine the role and position of the Ho Chi Minh Communist Youth Union; the task of the Party Committee in directly leading the organization of the Ho Chi Minh Communist Youth Union at the same level in terms of direction, tasks, ideology, organization and cadres is appropriate, and discipline is implemented, as a basis for the Party Committee and Party organization at all levels to pay attention and build a team of young cadres for the Party.
Limitedness, problems, and inadequacies: Some Party committees at all levels have not paid full attention to leadership, caring for and building the Youth Union, not regularly working, listening, and dialogue with young people. Some grassroots Party committees have not paid due attention to monitoring and inspecting youth work. The arrangement and assignment of union cadres when they are past the age of working in the union will face many difficulties, especially grassroots union cadres because the number of cadres and civil servants at the commune level is small.
2.12. Regarding the Party's finances (Article XI)
The Party's finances are implemented in accordance with the Party's Charter and State regulations. The level of party fee payment of party members is basically stable; revenue from party fees, revenue from the party economy (Party enterprises, Party public service units), State budget, and other revenue sources have basically ensured the Party's activities from the Central to grassroots party organizations and Party cells.
The Central Committee has prescribed and issued specific and unified guidance on the principles and regimes for the management of the Party's finances and assets, the level of Party member's Party fee payment; researched, supplemented and amended a number of specific regimes and policies to suit the reality, basically meeting the requirements and tasks of Party financial management, promoting discipline, order, and efficiency in managing and using the Party's finances and assets to ensure compliance with Party regulations and State laws. The annual regulations, the committee listens to reports and decides on financial tasks of its level, have been specified by the committee at all levels in the working regulations, implemented into a regime.
Party committees at all levels should pay attention to leading and directing the implementation of the Central Government's regulations and instructions on the regime of collecting and paying Party fees; basically manage and use the sources of operating expenses of Party committees and organizations at all levels according to the prescribed norms and regimes and strictly manage the Party's finances and assets. The inspection and auditing work for Party financial management has been increasingly strengthened and expanded in both scope and content, contributing to rectifying and overcoming limitations, gradually putting Party financial work into a disciplined, effective and basic manner in accordance with the provisions of the Party Charter and the laws of the State.
In general, the regulations on principles, the management regime of the Party's finances and assets, the level of party membership fees in the Party Charter and some regulations of the Central Committee are basically suitable, implemented uniformly from the Central to the grassroots level.
Limitedness, problems, and inadequacies: The collection and payment of party fees at some Party committees and organizations is still slow, not on time as prescribed, especially for Party members who are self-sufficient, self-employed, and self-sufficient students. Some party organizations are still confused in managing and using the retained party fees. Funds for the activities of Party committees at the grassroots and foreign levels are facing difficulties. The management of finance, assets and operations of some enterprises and public service units of the Party is still limited, some places have not received due attention, even allowing violations to occur to the point of requiring disciplinary action. Some documents on the implementation of financial management, assets, and party fees are not suitable and are slow to be supplemented and amended; the current regulations on the rate of party fee payment to the superiors of the Party cells under the grassroots Party Committee are high (70%).
II. GENERAL REVIEW
Based on the summary of the Central Committee, Party committees and organizations throughout the Party can affirm that over the past 15 years the Party Charter, the regulations and instructions of the Central Committee and of the Party committees at all levels have been seriously implemented by Party committees, Party organizations and Party members, making a very important contribution to building our Party to be increasingly clean and strong; a foundation for maintaining solidarity and unity throughout the Party; ensuring the comprehensive leadership of the Party over the State and society. The work of disseminating and thoroughly grasping the Party Charter, regulations and instructions of the Central Committee has always been proactively implemented by Party committees and organizations at all levels regularly and promptly, methodically, to the right subjects and plans; basically, cadres and Party members have a firm grasp of the Party Charter, regulations and instructions of the Central Committee; awareness and responsibility for implementing the Party Charter have been raised. The concretization of the Party Charter is focused on by the Central Committee, Party committees at all levels, and advisory and support agencies of Party committees at all levels. During the 11th, 12th and 13th Congresses of the Party, the Central Executive Committee has repeatedly issued regulations on the implementation of the Party Charter[43], at the same time, the Central Executive Committee, the Politburo, and the Secretariat have issued many resolutions, directives, regulations, regulations, and specific instructions on the contents of the Party Charter. The work of developing party members has achieved high results; the structure of party members has changed positively, the education, professional qualifications and skills of party members have been improved, the proportion of young party members, women, ethnic minorities and religious people has increased.
The Central Executive Committee, the Politburo and the Secretariat uphold the principle of democratic centralism in activities and always be united and highly unified in their decisions; strongly innovate the methods of governance, focus on comprehensive and synchronous leadership and direction in all aspects of work, meet practical requirements, decide on all successes of our country's revolutionary cause, ensure to maintain and strengthen the Party's leadership role towards the State and society. Standing committees and committees basically perform their functions, tasks, working regulations, and authority correctly, demonstrating the leadership role of the Party in the locality; regularly inspect, supervise, promptly rectify incorrect contents, overcome limitations in the implementation process. The majority of grassroots party organizations have promoted their role as the political core at the grassroots level, leading cadres, party members and people to successfully complete the political tasks of localities, agencies and units. The leadership position and role of the Party organization in the Army and the Police are increasingly affirmed and strengthened. The Politburo, Secretariat, Party committees and inspection committees at all levels have focused on leading, directing and organizing the comprehensive implementation of inspection and supervision tasks according to the provisions of the Party Charter, regulations and instructions of the Central Government with a determined spirit, focusing on and focusing on, closely following political tasks and Party building work; strengthening inspection of the implementation of Party building and rectification work, associated with promoting the study and following of Ho Chi Minh's ideology, morality and style, the fight against corruption, waste and negativity. Basically, Party committees at all levels strictly implement the Party Charter, regulations and instructions of the Central Committee on disciplining Party organizations and Party members who violate. The settlement of complaints and party discipline has been paid attention to by Party committees and inspection committees at all levels, and implemented cautiously and objectively; the disciplinary action against party organizations and party members who violate the law has been carried out promptly, strictly, in accordance with authority and procedures, ensuring principles, directions and motto in disciplinary action.
During the past terms, although the Party Charter was not amended, the 12th and 13th Congresses decided or assigned the Central Executive Committee to concretize many important and urgent contents and issues of the Party into the regulations and guidelines of the Central Committee to decide on revolutionary issues of the Party, creating a solid basis for our country to confidently and steadily move forward into a new era, an era of growing and developing the nation's wealth and prosperity, such as: introducing re-election. position name of General Secretary for the third term; Organize local government at 02 levels, do not organize district level, merge commune-level administrative units; End the activities of party unions and party committees at the central and provincial levels; pilot the Politburo and higher-level Party Committees to appoint executive committees, standing committees, secretaries, deputy secretaries, inspection committees, directors and vice-chairmen of inspection committees of centrally-affiliated party committees and places where new party committees and party organizations are established; pilot the organization of commune, ward, and special zone party committees directly under the provincial and city party committees, which are the direct superior party committees of the grassroots party organization... affirming the close adherence and strict observance of the Party Charter; the Party's organizational and operational principles, within its authority; Flexible leadership and direction, meeting the requirements of the country's development in the new situation.
The above results have been achieved because: (1) The Party Charter has clearly defined the principles, purposes, ideological systems, principles of organization, operation, organizational systems, methods of leadership and governance of the Party and stipulated the responsibilities, obligations, and powers of the Party organization and Party members; and has been implemented stably over many terms. (2) Regular and close leadership and direction of the Central Executive Committee, the Politburo, the Secretariat and Party committees and organizations at all levels. (3) The proactiveness, positivity, and responsibility of advisory and support agencies of Party committees at all levels. (4) The self-conscious awareness and strict compliance of the Party organization and Party members. (5) Inheriting and promoting the results and experiences of previous terms.
However, the implementation of the Party Charter still has some limitations and problems: Some Party committees, Party organizations and Party members do not fully understand the meaning and importance of the Party Charter; regular study, in-depth research, and mastery of the Party Charter and the regulations and instructions of the Central Committee of Party committees, Party organizations and Party members in some places are still limited. Some Party Committee members and Party members have not strictly followed the Party Charter, but have also violated the principle of democratic centralism and the principles of organization and operation of the Party, violated working regulations; have not properly performed the tasks, rights and responsibilities of Party organizations and Party members. Some contents in the Party Charter, regulations and instructions are still inadequate, not comprehensive to all subjects and not synchronous, the concretization of some regulations is not timely. In the activities of the Party Committee and Party cell, self-criticism and criticism are sometimes not practical, not regular, and the situation of being afraid of conflicts, avoiding and being afraid of collisions still occurs in many places. The role and fighting strength of many Party cells are still weak, and violations of cadres and Party members during their work and activities have not been promptly detected. The implementation of regulations on disciplining party organizations and party members in some party organizations is not serious, there are still phenomena of being lenient, avoiding, and localized; in some cases, there are no principles, procedures, and no authority, procedures, or regulations. Some party members take advantage of their right to complain and denounce to cause disunity, negatively affect the honor and reputation of party members and party organizations, and violate regulations on what party members are not allowed to do.
In addition to the limitations and problems mentioned above, although not amending the Party Charter, the 13th Congress agreed to study and absorb the Congress's opinions to concretize them into the Central regulations and instructions and important revolutionary issues being implemented. In the process of implementing the Party Charter, there are some contents in the regulations and instructions that are still inadequate: (1) Regarding concretizing the principle of democratic centralism; (2) About the age to enroll party members, about party membership cards, about introducing party activities and temporary party activities; (3) Regarding the case where the structure is specified as a member or secretary of the party committee but is not a member of that party organization; (4) Regarding the upper-level party committee of the grassroots party organization and the grassroots party organization (not appropriate); Party organization models in places with unique characteristics (not clearly defined); (5) Regarding the functions and tasks of grassroots party organizations, party cells do not cover all types; (6) Regarding the Party's leadership agencies at the local level (provincial and commune levels); about party committees and sections; (7) Some specific regulations on the Party's inspection, supervision and disciplinary enforcement; Disciplinary authority of the standing committee and inspection committee of the grassroots party committee; (8) Some regulations on reward work and disciplinary statutes, arrangement and use of cadres and party members after being disciplined; (9) Regarding the organization and leadership methods of party organizations, party members in State leadership agencies, the Fatherland Front, and socio-political organizations established by elections; in executive and judicial agencies at the central and provincial levels; Party leader of the Ho Chi Minh Communist Youth Union; (10) Some documents on the implementation of party fee work; (11) Regarding digital transformation and administrative reform within the Party.
III. ON ADDITIONS AND AMENDMENTS TO THE PARTY'S CHARTER
1. viewpoints and principles
- Ensure the leadership of the Party, the principles of organization and operation of the Party, especially the principle of democratic centralism; steadfastly markism - Le Nin, Ho Chi Minh's ideology, the theory of the reform guidelines; steadfastly pursue the goal of national independence and socialism; steadfastly promote comprehensively and synchronously the cause of innovation; synchronously with the addition and amendment of the Political platform and the Constitution.
- Inheriting and maintaining the Party's principal and substantive contents.
- The Party's Charter should not be too detailed and specific. The contents of the regulations on the implementation of the Party Charter are clear, in line with the overall model of the organization of the apparatus of the political system and in practice, it is necessary to study, supplement and amend.
2. Based on the above viewpoints and principles; summarizing 15 years of implementing the Party Charter, proposals and recommendations from Party committees and organizations directly under the Central Government and the reality set forth, the Central Executive Committee reported to the 14th Congress to assign the 14th Central Executive Committee:
2.1. Consider and decide on a number of major and important policies and tasks that have not been stipulated in the Party Charter or are stipulated in the Party Charter but are no longer suitable to the practical situation; report the implementation results to the next National Party Congress for consideration and approval.
2.2 Lead and direct research and summarize practical proposals to amend and supplement the Party Charter and the Political foundation for National Construction during the period of transition to socialism to submit to the 15th National Party Congress on the occasion of the 100th anniversary of the founding of our Party (1930 - 2030).
2.3. Orient the content and assign the Politburo to direct competent agencies to conduct research and summarize the implementation of the Party Charter from the beginning of the term to report to competent authorities for consideration and proposal to supplement and amend the Party Charter according to each chapter and article of the Party Charter, focusing on the following chapters and Articles: (1) Article 7 on exemption from Party activities in some special cases; (2) Clause 2, Article 10 on the establishment of grassroots Party organizations under the leadership of district, county, town and city Party committees under the province; the establishment of Party organizations in places with special characteristics. (2) Chapter IV on Party leadership agencies at all levels. (3) Chapter V on grassroots party organization; departmental party; Party cell; periodic activities of grassroots party committees and Party cells. (4) Clause 3, Article 28 on party organization in the Vietnam People's Army and the Vietnam People's Public Security. (5) Chapter VII on appointing inspection committees at all levels if necessary; the direction of the superior inspection committee on the Party Committee, Party organization, and lower-level inspection committee in inspection, supervision, and discipline of the Party; adding the task of controlling the assets and income of the inspection committee from the commune level and above; raising the level of supervision work... (6) Chapter VIII reviews and amends the authority to enforce discipline, resolve complaints and denunciations of the Party organization according to the current organizational model. (7) Article 42, Article 43 Chapter IX on the Party leading the State, the Fatherland Front and socio-political organizations. 8. Chapter X on the Party leadership of the Ho Chi Minh Communist Youth Union. 9.3 Other contents to ensure the principle, systematization, unity, synchronization, and clarity of the Party Charter; related contents on the results of implementing Resolution 18 on the arrangement and consolidation of the political system.
