Ms. Truong Thi My (name of the character changed) said that she was a non-specialized worker in charge of poverty reduction - employment, concurrently protecting and caring for children at the Ward People's Committee from 2009 to 2024 and participated in compulsory social insurance (BHXH) from 2016.
In September 2024, she passed the civil servant exam for Culture - Society, and was ranked as a salary grade 1, coefficient 2.34, lower than the coefficient 3.0 she had previously enjoyed.
Citing the provisions of Article 19 of Decree 138/2020/ND-CP on calculating the working time with compulsory social insurance contributions to rank ranks and salary grades when recruiting civil servants, Ms. My requested the Ministry of Home Affairs to clarify whether her previous working time was calculated to rank corresponding salary grades or not; if not, what is the legal basis and reason?
Regarding her proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
The Ministry of Home Affairs said that Article 20 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government stipulates: In case the person recruited into the civil service according to the provisions of this Decree has worked in accordance with the provisions of law in accordance with the professional qualification requirements of the recruited job position, has paid social insurance (if not continuously but has not received a one-time social insurance allowance, it is accumulated), is assigned to work in accordance with the professional qualifications and skills previously held, then that working time is calculated as a basis for ranking salaries in the corresponding civil service rank according to the recruited job position.
Salary ranking for people recruited into civil servants who have worked and paid compulsory social insurance is guided in Circular No. 01/2026/TTBNV dated January 9, 2026 of the Minister of Home Affairs.
Based on the above regulations and based on the tasks and powers of the People's Committees, Chairmen of People's Committees of provinces and cities directly under the Central Government and the responsibilities and powers of civil servant use agencies specified in Article 67, Article 68 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government, the Ministry of Home Affairs requests you to exchange with the management agency, civil servant use agency where you work for consideration, guidance, and resolution according to your authority.
