The Ministry of Home Affairs is seeking opinions on the Circular amending and supplementing a number of articles of the Joint Circulars, the Circular of the Minister of Home Affairs stipulating the regime and policies for Veterans and Youth Volunteers.
According to the draft submission, currently, the whole country has about 4 million members of the Vietnam Veterans Association; 48,769 youth volunteers during the resistance war against France and 282,690 youth volunteers during the resistance war against the US are enjoying regimes and policies according to the provisions of law. The settlement of regimes and policies for these subjects is carried out regularly and continuously in localities.
However, through reviewing current regulations and summarizing the implementation of circulars, it shows that there are still some contents that are not consistent with the provisions of law and practical requirements.
The draft inherits the provisions of Circular No. 03/2020/TT-BLDTBXH on the scope of adjustment, subjects of application, principles of settlement and levels of benefits for veterans, only focusing on amending the order and procedures for settlement in a direction suitable to the 2-level local government organization model.
According to Article 3 of Circular No. 03/2020/TT-BLDTBXH, the settlement of funeral expenses for veterans is implemented similarly to for people with meritorious services to the revolution.
Accordingly, in Article 122 of Decree No. 131/2021/ND-CP dated December 30, 2021 of the Government, procedures for resolving funeral expenses for people with meritorious services to the revolution are being implemented within 24 working days.
The draft Circular has proposed building separate dossiers and procedures for veterans to suit the specific nature of the policy. Accordingly, in addition to abolishing the district-level resolution stage, stipulating that commune-level People's Committees receive and certify dossiers, transfer them to the Department of Home Affairs for appraisal, and issue decisions to resolve regimes, the draft has proposed a total number of working days to resolve regimes down to 15 days (a reduction of 7 working days compared to before). At the same time, it supplements regulations on electronic data exploitation, diversifying dossier submission methods.
Amending point a, clause 1, Article 4 of Circular No. 03/2020/TTBLĐTBXH stipulating the allowance regime when resigning from the Association, in accordance with the organizational structure of the Vietnam Veterans Association currently from the Central to provincial levels.
The amendment does not change the subjects of application, conditions for enjoyment, level of enjoyment and funding sources for implementing the regime for veterans.
Regarding the regulations on health insurance regimes in Article 2 of Circular No. 03/2020/TT-BLĐTBXH, the Department of People with Meritorious Services proposes to maintain them because no problems arise in practice and they are still in accordance with current legal regulations.
According to Clause 2, Article 57 of the Law on Promulgation of Legal Documents in 2025, detailed regulations are still applied if they are not contrary to new legal documents.
At the same time, expanding the scope of amendments only to update citation regulations may affect the form of drafting documents as prescribed in Clause 4, Article 8 of the Law.
