This is one of the notable points in the draft Decree amending and supplementing a number of articles of Decree No. 29/2023 of the Government on staff streamlining, drafted by the Ministry of Home Affairs. The Ministry of Justice is reviewing this draft Decree.
In the Draft Decree, the Ministry of Home Affairs clearly states 2 subjects that have not implemented staff streamlining, including:
First, those who are pregnant, on maternity leave, or raising children under 36 months old, except for individuals who voluntarily reduce their staff.
Second, those who are in the process of considering disciplinary action or being prosecuted for criminal liability or being inspected or examined for signs of violations.
The draft also states 4 subjects that will implement the staff streamlining policy. First is that cadres, civil servants, public employees; commune-level cadres, civil servants and people working under labor contracts are subject to the same regime and policies as civil servants as those prescribed by the Government.
Second is that those working under an indefinite-term labor contract regime performing professional work in the list of common professional and technical positions in public service units according to the Government's regulations are redundant due to reorganization or restructuring the unit's human resources according to the decision of the competent authority.
Third is that part-time workers at the commune level will retire immediately from the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government to be considered and approved by the National Assembly.
Finally, there is a group of non-professional workers in villages and residential groups that are redundant due to the arrangement of villages and residential groups, and will retire immediately after the arrangement decision of the competent authority.
