On December 4, in Hanoi, Prime Minister Pham Minh Chinh chaired a special Government meeting on law making in December 2024.
At the meeting, Government members discussed and gave their opinions on the Draft Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site submitted by the Ministry of National Defense; the Proposal to develop a Law amending and supplementing a number of articles of the Law on Economical and Efficient Use of Energy submitted by the Ministry of Industry and Trade; the Proposal to develop a Law on Atomic Energy (amended) submitted by the Ministry of Science and Technology; and the Proposal to develop a Law on Execution of Temporary Detention, Temporary Imprisonment and Prohibition from Leaving the Place of Residence submitted by the Minister of Public Security.
This afternoon, Government members continued to discuss and give opinions on the Proposal to develop the Law on Government Organization (amended) and the Proposal to develop the Law on Local Government Organization (amended).
In particular, Government members discussed and gave their opinions enthusiastically on the proposal to draft a Law amending and supplementing a number of articles of the Law on Enforcement of Criminal Judgments.
Government members requested the Ministry of Public Security to continue to carefully study the regulations on monitoring measures for people serving suspended sentences, non-custodial reform sentences, residence bans, probation, and people released from prison early with conditions to ensure feasibility, effectiveness, and suitability.
Consider not proposing regulations on the organization of prisons in the law but assigning the Government to regulate according to its authority, to ensure compliance with the policies of the Party and the National Assembly.
Concluding on this content, Prime Minister Pham Minh Chinh basically agreed with the goals and content of the policy.
However, according to the Prime Minister, the proposal to supplement regulations on rights, obligations and regimes for prisoners is related to many other legal documents on a number of areas such as medical examination and treatment, tissue and body part donation; therefore, the Ministry of Public Security is requested to continue researching and reviewing to ensure consistency and synchronization in the legal system.
Regarding opinions related to the detention and temporary detention of mentally ill subjects, according to the Prime Minister, those who are sick must be exempted from detention, temporary detention and medical treatment according to human rights. The Ministry of Health manages the examination and treatment of patients, and if they are criminals, of course the Ministry of Public Security manages.
However, the two agencies must coordinate with each other in special cases and the Government will have specific regulations on this coordination.
According to the Prime Minister, reforming prisoners through labor is necessary because in order to reform prisoners, they must work, provide vocational training, and create jobs for those being reformed so that when their terms expire, they can better integrate into the community, have new jobs, not commit crimes, and can work in and out of prison depending on the programs arranged by the reform camp.
The Prime Minister assigned the Ministry of Public Security to preside over and coordinate with the Ministry of Justice and the Government Office to review and fully absorb the opinions of Government members, relevant ministries and agencies at the Session; complete the dossier proposing the development of the Law according to regulations, send it to the Ministry of Justice for synthesis and supplementation to the National Assembly's 2025 Law and Ordinance Development Program.
