Deputy Prime Minister Nguyen Hoa Binh has just signed Decision 1589/QD-TTg of the Prime Minister promulgating the Plan to implement the Law on Organization of Local Government No. 72/2025/QH15.
In particular, the Ministry of Home Affairs will preside over and coordinate with the Ministry of Justice, the Government Office and relevant agencies and organizations to develop a Government Decree regulating the framework for the number of Vice Chairmen of the People's Committee; the number and structure of People's Committee members; the order and procedures for proposing to approve the results of the People's Council electing, dismissing, and removing Chairmen and Vice Chairmen of the People's Committee; the order and procedures for transferring, removing Chairmen and Vice Chairmen of the People's Committee, and assigning the authority of the Chairman of the People's Committee, to be completed in August 2025.
Develop a Government Decree regulating the duties, powers, organization and operation of the People's Committee, Chairman of the People's Committee, specialized agencies and other administrative organizations under the People's Committee of the special zone as prescribed in Clause 2, Article 28 of the Law on Organization of Local Government, to be completed in September 2025.
Previously, the amended Law on Organization of Local Government passed by the National Assembly at the 9th Session stipulated the duties and powers of the Chairman of the Provincial and Commune People's Committees.
The Chairman of the Provincial People's Committee is responsible for leading and being responsible for the operation of the local state administrative apparatus, ensuring the unity and smoothness of the administration; for implementing administrative reform, reforming public services and civil servants in the system of state administrative agencies in the locality.
Direct and organize the implementation of socio-economic development tasks, develop sectors and fields, develop urban areas, develop private economy, develop science, technology, innovation and digital transformation in the locality.
Direct and be responsible for the recruitment, use, management of civil servants and public employees, use and development of human resources, labor, employment, and social insurance in the area according to the provisions of law.
Decide to appoint, dismiss, transfer, remove from office, reward, and discipline the head or deputy head of another professional agency, administrative organization, or public service unit under the People's Committee at its level.
Meanwhile, the Chairman of the Commune People's Committee is responsible for leading, directing, urging, and inspecting the work of other specialized agencies and administrative organizations under the People's Committee at his level.
Direct and be responsible for organizing the implementation of local budget estimates; effectively manage and use investment capital, finance, budget sources, public assets, infrastructure assigned in the area according to the provisions of law and decentralization of the provincial People's Committee.
Direct and organize the implementation of the recruitment, use and management of civil servants and public employees in the area according to the provisions of law and the decentralization of the superior state agency.
Decision to appoint, dismiss, transfer, and remove from the position of head or deputy head of another professional agency or administrative organization or public service unit under the People's Committee at his/her level; decision to temporarily suspend the work of the Vice Chairman of the People's Committee at his/her level, the head of another professional agency or administrative organization, or public service unit under the People's Committee at his/her level.
Organize the implementation of citizen reception, complaint and denunciation settlement, prevention and control of corruption, waste and negativity in the activities of local authorities at their level and in socio-economic activities in the area according to the provisions of law.
