The Ministry of Home Affairs said that our country is actively implementing a two-level local government organization model (provincial and commune levels).
The book "Handbook of organization and operation of local government at the commune level" was compiled by the Ministry of Home Affairs to provide systematic, complete and easily accessible information for commune-level cadres and civil servants in implementing the Law on Organization of Local Government 2025 and new relevant legal documents.
In the handbook, the Ministry of Home Affairs answered the question of how to resolve the case of performing tasks according to decentralization and delegation leading to changes in administrative procedures that have been stipulated in legal documents of superior state agencies?
The Ministry of Home Affairs said that Clause 7, Article 13 and Clause 6, Article 14 of the Law on Organization of Local Government 2025, stipulating that in cases where it is necessary to change the order, procedures, and authority stipulated in legal documents of superior state agencies to carry out decentralization and delegation according to regulations, the People's Council, People's Committee, and Chairman of the Provincial People's Committee shall adjust those provisions in the decentralization and delegation documents (in case other agencies, organizations, and individuals are authorized, the Chairman of the Provincial People's Committee shall adjust them to perform the assigned tasks and powers;
Ensure the requirements for administrative reform in the direction of reducing administrative procedures, promoting the application of information technology, digital transformation in handling administrative procedures, not specifying additional documents, not increasing additional requirements, conditions, and processing time for current procedures.
The Chairman of the Provincial People's Committee is responsible for publicizing administrative procedures with changes and adjustments to the provisions of this Clause in accordance with the provisions of law.
After that, the Chairman of the Provincial People's Committee is responsible for synthesizing and reporting to the central state management agency on relevant sectors and fields on adjusting the order, procedures, and authority to perform the tasks and powers assigned in his/her locality.
