The Lao Dong Newspaper Legal Consulting Office replied:
Clauses 3, 4, Article 5 of Decree 172/2025/ND-CP regulating disciplinary action against cadres and civil servants (effective from July 1, 2025) stipulates as follows:
3. Except for the case specified in Clause 4 of this Article, the statute of limitations for disciplinary action is stipulated as follows:
a) 05 years (60 months) for violations to the extent of being disciplined by reprimand;
b) 10 years (120 months) for violations not falling under the provisions of Point a of this Clause.
4. Violations that do not apply the statute of limitations for disciplinary action:
a) Cadres and civil servants who are party members who have committed violations to the extent of being subject to disciplinary action by expelment;
b) Violating regulations on internal political protection work;
c) Performing acts that violate national or ethnic interests in the fields of national defense, security, and foreign affairs;
d) Using fake or unlicensed degrees, certificates, certificates, and confirmations.
Thus, from July 1, 2025, the act of not applying the statute of limitations for disciplinary action against civil servants is regulated as above.
