The Lao Dong Newspaper Legal Consulting Office replied:
Clause 2, Article 10 of the Law on Social Insurance 2024 stipulates that beneficiaries of social insurance regimes have the following rights:
a) Receive full, timely and convenient social insurance regimes;
b) Receive health insurance in case of receiving pension; take a monthly leave to receive allowances for work-related accidents and occupational diseases; during the leave to enjoy maternity benefits for 14 working days or more in a month; during sick leave for 14 working days or more in a month or sick leave to receive allowances for employees with diseases on the list of diseases requiring long-term treatment issued by the Minister of Health; are receiving the regime prescribed in Article 23 of this Law;
c) Be paid for medical examination fees in cases where the employer does not recommend them for examination to assess the level of reduced working capacity, but the results of the medical examination are eligible for social insurance benefits according to the provisions of this Law;
d) authorize in writing another person to perform social insurance. In case of authorization to receive pensions, social insurance benefits and other regimes as prescribed in this Law, the authorization document is valid for a maximum of 12 months from the date of establishment of authorization. The authorization document must be certified in accordance with the provisions of the law on certification;
d) For people aged 80 and over who have a need, they must be authorized by the social insurance agency or a service organization authorized by the social insurance agency to pay pensions and social insurance benefits at their place of residence in Vietnam;
e) Be provided monthly by the social insurance agency with information on social insurance benefits via electronic means; be confirmed by the social insurance agency with information on social insurance benefits when required;
g) Complaints, denunciations and lawsuits against social insurance in accordance with the provisions of law;
h) Reject to enjoy social insurance benefits.
Thus, beneficiaries of social insurance benefits have the above rights.
