The Lao Dong Newspaper Legal Consulting Office replied:
Article 11 of Decree 303/2025/ND-CP stipulating the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies (effective from November 20, 2025) stipulates the number of deputy heads of departments, offices, inspectorates, departments and equivalents, public service units under the organizational structure of the ministry as follows:
1. The number of deputy heads of departments, offices, inspectors, type 2 departments, public service units under the organizational structure of the ministry is arranged to be an average of no more than 03 people per unit.
2. In case the type 2 department, office, or department is established on the basis of merging or merging from 02 agencies, the number of deputy heads will be increased by 01 person compared to the number of deputy heads prescribed in Clause 1 of this Article; the type 2 department, office, or department established on the basis of merging or merging from 03 or more agencies, the number of deputy heads will be increased by 02 people compared to the number of deputy heads prescribed in Clause 1 of this Article; the type 2 department, office, inspectorate, or department receiving functions, tasks, or organization according to the decision of the competent authority, the number of deputy heads will be increased by 01 person compared to the number of deputy heads prescribed in Clause 1 of this Article.
3. The number of deputy heads of type 1 departments is arranged to an average of no more than 04 people per department.
4. Based on the criteria and principles for determining the number of deputy capces prescribed in this Decree, the Minister shall determine the total number of deputy capces of agencies, organizations and units under his/her management and decide on the specific number of deputy capces of each agency, organization and unit according to his/her authority.
Thus, the number of deputy heads of departments, offices and equivalents is regulated as above.
