Ministry of Home Affairs responds to the establishment of People's Inspection Committees in communes

Ministry of Home Affairs informs about the establishment of People's Inspection Committees in communes, wards and towns.

Ms. Phan Xuan Hong (Dak Nong province) learned that the Law on Grassroots Democracy Implementation in 2022 and Decree No. 59/2023/ND-CP stipulate that: People's Inspection Committees established in communes, wards and towns are managed and guided by the Vietnam Fatherland Front Committee at the commune level, while People's Inspection Committees at agencies and units are guided by the grassroots Trade Union.

"However, there are currently many opinions that the requirement for grassroots trade unions at the commune level to establish a People's Inspection Committee operating within the commune agency is right or wrong?" - Ms. Hong wondered.

Regarding the reflection and recommendation of Ms. Phan Xuan Hong, the Ministry of Home Affairs said:

Regarding the organization of the People's Inspection Committee in communes, wards and towns, it is stipulated in Clause 1 and Clause 2, Article 36 of the Law on Grassroots Democracy Implementation in 2022 as follows:

The People's Inspection Committee in communes, wards and towns consists of members elected from villages and residential groups in the commune. The number of members of the People's Inspection Committee corresponds to the number of villages and residential groups in the commune but must not be less than 5 people.

The term of the People's Inspection Board follows the term of the Village Chief or Head of the Residential Group in the same area. During the term, if a member of the People's Inspection Board fails to fulfill his/her duties, is no longer trusted, or requests to resign, the Vietnam Fatherland Front Committee at the commune level shall request the village or residential group that elected that member to consider and dismiss him/her from his/her duties.

In case there is a vacancy in the People's Inspection Committee during the term and the remaining term is 06 months or more, the Front Working Committee in the village or residential group shall coordinate with the Village Chief and the Head of the Residential Group to organize the election of additional members of the People's Inspection Committee according to the instructions of the Vietnam Fatherland Front Committee at the commune level.

Regarding the activities of the People's Inspection Committee in communes, wards and towns, it is stipulated in Clause 1, Article 39 of the Law on Grassroots Democracy Implementation in 2022: The People's Inspection Committee in communes, wards and towns is directly directed and guided in its activities by the Vietnam Fatherland Front Committee at the commune level.

The responsibility of the Vietnam Fatherland Front Committee at the commune level in ensuring the operation of the People's Inspection Committee in communes, wards and towns is stipulated in Clause 2, Article 40 of the Law on Grassroots Democracy Implementation in 2022 and specific provisions in Articles 13 and 14 of Decree No. 59/2023/NDCP on the organization and operation of the People's Inspection Committee in communes, wards and towns.

According to the Ministry of Home Affairs, based on the above regulations, in communes, wards and towns, the People's Inspection Committee is elected by the Vietnam Fatherland Front Committee at the commune level to guide the organization of conferences of the residential community in villages and residential groups to elect or dismiss members of the People's Inspection Committee and directly direct and guide the activities according to regulations.
