On July 28, information from the Dak Lak Provincial Inspectorate said that the unit is implementing an inspection plan for 17 projects with a total investment of VND30 billion or more.
On the same day, the Dak Lak Department of Finance informed that the department had been assigned by the Dak Lak Provincial People's Committee to coordinate with the Department of Construction to carry out related tasks.
Previously, on July 22, the Government Inspectorate issued a thematic inspection plan for works and projects with difficulties, problems, delays, prolonged backlogs, low efficiency, and the risk of loss and waste.
In Dak Lak, the Government Inspectorate assigned the Provincial Inspectorate to conduct inspections of 17 projects in Dak Lak (including the former Phu Yen and Dak Lak provinces). In particular, there are projects being implemented in the form of public-private partnership (PPP), the type of construction - transfer (BT) contract.
According to the records, in February 2018, the Chairman of the Dak Lak Provincial People's Committee signed a decision approving the plan to select a contractor to invest in the form of public-private partnership to implement the Giai Phong road project, the section from Nguyen Chi Thanh Street to the km5 bung no, National Highway 26, Buon Ma Thuot (abbreviated as the N19 road project). The total investment capital is nearly 400 billion VND, the total length of the route is 2.1km; the land use area is nearly 8ha.
Accordingly, Binh Minh Company Limited (in Dak Lak) is the unit designated to implement the project; type of construction - transfer contract. The implementation period is 36 months.
However, up to now, this project has only implemented about 500m of co-ordinated road.

According to research, since 2021, when the PPP Law stopped implementing BT contracts for new investment projects, projects like this have encountered many problems. The reason is that there are still some shortcomings such as the value of BT works being determined incorrectly; most projects have higher investment rates than projects using public investment capital.
In addition, investor selection is mainly done through the form of non-competitive bidding; supervision work is taken lightly, leading to unguaranteed construction quality. In some localities, there are still problems with general planning, land use planning...
This has also greatly affected the construction progress of the above project. The People's Committee of Buon Ma Thuot City (at the time of the merger) did not have enough basis to propose that the Dak Lak Provincial People's Committee issue a commitment document and allocate land to pay the investor.
According to Mr. Nguyen Duy Cuong, representative of Binh Minh Company Limited, when the project investment policy was issued, the company coordinated with local authorities to carry out site clearance and project construction.
Currently, the company has invested more than 300 billion VND in the project, but has not yet recovered any money. All investment money in the project is borrowed from the bank.
The Chairman of the Dak Lak Provincial People's Committee has held two meetings of departments and branches. In particular, departments and branches agreed that if they do not commit to paying the land fund, according to regulations, the project can be stopped to be re-implemented in the direction of using the State budget to pay investors.
Before removing the district level, the People's Committee of Buon Ma Thuot City held a meeting to implement. However, to do this, it is necessary to adjust the decision on the project's feasibility study report, adjust the investment policy due to the increase in total investment due to price changes" - Mr. Nguyen Duy Cuong said.
In addition, the Government Inspectorate also assigned the Dak Lak Provincial Inspectorate to inspect the Ea Phe - Ea Kuang - Vu Bon inter-commune traffic road project, in the old Krong Pac district.
Accordingly, in 2020, the Dak Lak Department of Planning and Investment (now the Department of Finance) announced that the above project was invested in the form of PPP (BT contract) with a total investment of more than 60 billion VND; more than 11km long, land use area of more than 7.5ha. The road surface is made of medium-sized cement concrete, drainage system and traffic safety system on the route with cross-section. The project has been completed.
