Clause 7, Article 39 of Decree 168/2024/ND-CP stipulates a fine of 40 to 50 million VND (high fine according to this Article) for driving test centers that commit one of the following violations:
Arbitrarily changing or using examination software, scoring equipment, or examination vehicles without the approval of the competent state management agency.
Using a computer in the theory test room connected to a line outside the test room is against regulations.
Intentionally allowing scoring equipment and facilities to operate incorrectly during the examination period; leaving signs and symbols contrary to regulations on the examination yard or examination vehicle during the examination period.
In addition to the above fines, individuals and organizations involved in driving test activities will be fined in the following cases:
Fines from 15 million VND to 20 million VND for individuals, from 30 million VND to 40 million VND for organizations that organize driver recruitment and training without a driver training license.
Fines from 20 million to 30 million VND shall be imposed on driving training facilities and driving testing centers that commit one of the following violations:
Driving training facilities organize recruitment and training for drivers with licenses that are not allowed to be trained.
Driving training facilities do not provide training in accordance with prescribed content, programs, and curriculum.
Driving training facilities consider completing training courses or granting primary certificates or granting training certificates to students in violation of regulations.
Driving training facilities use technical measures, peripheral equipment, and other measures to interfere with the operation process, distorting data of the device that monitors theoretical study time, time, and distance of practical driving study.
The driving test center does not install enough surveillance cameras in the theoretical test room, simulated traffic situations, and testing yard according to regulations, or has installed surveillance cameras but they do not operate according to regulations.
The driving test center has more than 50% of the licensed driving test vehicles in the picture that do not meet the conditions for testing according to regulations.
The driving test center has more than 50% of licensed driving test vehicles on the road that do not meet the conditions for testing according to regulations.
Driving test centers have more than 50% of licensed theory test computers that do not meet the required testing conditions.
The driving test center arbitrarily moved the location of functional rooms; changed the shape of the test papers without approval from the competent state management agency;
The driving test center does not store or does not store complete records as prescribed for 2 or more driving test periods.
Fines from 10 million VND to 20 million VND shall be imposed on driving training facilities and driving testing centers that commit one of the following violations:
Driving training facilities organize recruitment and training exceeding the capacity specified in the driving training license.
The driving training facility organizes driving training outside the location stated in the driving training license.
The driving training facility does not store or does not store complete records as required for 2 or more training courses.
Driving training facilities arrange for students to practice driving on practice vehicles exceeding the prescribed number.
Driving training facilities do not have enough classrooms; classrooms do not have enough equipment and teaching aids.
Driving training facilities do not have enough driving practice grounds or the driving practice grounds do not meet the required conditions.
Driving training facilities do not have enough training vehicles of all classes to meet the actual training volume at any given time or use training vehicles of the wrong class to teach driving practice.
Driving training facilities do not have enough equipment to monitor students' theoretical study time, time, and driving practice distance, or have such equipment but it does not operate according to regulations.
The driving test center does not have a public announcement sound system for violations of driving test candidates in the diagram as prescribed or has an announcement sound system but it does not operate as prescribed during the driving test in the diagram.
The driving test center does not have enough screens to publicly display monitoring images of the theoretical test room, simulated traffic situations, and driving test results as prescribed, or has enough screens but they do not operate as prescribed during the test.
