The Ministry of Health proposes that cosmetic advertising should not use the words: treatment, top-notch, completely recover

In the draft Decree regulating cosmetic management, the Ministry of Health proposes many regulations on cosmetic advertising.

The Ministry of Health is seeking opinions on the draft Decree regulating cosmetic management (replacing Decree 93/2016/ND-CP regulating cosmetic production conditions).

According to the draft, cosmetic businesses are responsible for the content advertised by the businesses for cosmetic products and do not have to confirm the content of cosmetic advertisements to the management agency.

The content of cosmetic advertising must be consistent with the inherent nature of the cosmetic product, product classification and features and uses that have been published according to the provisions of law.

Do not advertise cosmetic products that create misunderstandings that the product is a drug.

No images, costumes, names, correspondence, or articles of other units, medical facilities, doctors, pharmacists, or medical staff are allowed to be used.

The draft clearly states that information and images must not be used in cosmetic advertising content:

- Information and images banned from advertising activities as prescribed in the Advertising Law;

- Do not use sentences, words, or images that are too constructive, leading to misunderstandings as drugs or over-advertising the product's features and uses;

- The content of introducing cosmetic product advertising features is not accepted as prescribed in Appendix No. 25 attached to this draft Decree.

Compulsory content when advertising cosmetic products

According to the draft, the content of cosmetic product advertising must include the following mandatory information: cosmetic product name; features and uses of cosmetic products; names and addresses of organizations and individuals responsible for bringing products to the market; warnings according to the provisions of international agreements.

Advertising cosmetic products in newspapers and images must clearly read the content of cosmetic product names; features and uses of cosmetic products; warnings according to international agreements.

According to the Ministry of Health, after 8 years of implementation, in addition to the achieved results, the implementation of Decree 93/2016/ND-CP regulating cosmetic production conditions has revealed some shortcomings in the issue of cosmetic announcement, post-inspection, cosmetic production... Therefore, new regulations are needed to overcome the shortcomings and limitations of the Decree and resolve problems arising in practice...
