The Ministry of Agriculture and Environment informs about the issuance of red books for lost land before 1980

The Ministry of Agriculture and Environment has just responded to citizens in Da Nang asking about granting red books for the vacant land left by their ancestors.

On the Government Portal, Mr. N.T (in Da Nang) reported that his family has 300 m2 used for livestock and crop. The origin is the vacant land from the time of our ancestors (before December 18, 1980), not contested, not encroached on traffic corridors, public irrigation works...

Mr. T asked, now do you want to do the procedures for granting red books for agricultural land or garden land for the above land? If so, what are the procedures?

The Ministry of Agriculture and Environment responds to this issue as follows:

The content of his reflection was unclear in procedures, not complete in information and documents, therefore, the Ministry of Agriculture and Environment had no basis to give specific answers.

The Ministry informed some contents for him to study and refer to during the implementation of land administrative procedures as follows:

In case the land user does not have documents on land use rights as prescribed in Article 137 of the Land Law and does not violate land laws, is not a case of land allocated without proper authority but needs to register and issue a Certificate, he/she will be considered for granting a Certificate according to the provisions of Article 138 of the Land Law.

In case the land user violates the law on land before July 1, 2014 and needs to register and issue a Certificate, the Certificate will be considered for issuance according to the provisions of Article 139 of the Land Law.

The Ministry of Agriculture and Environment recommends that you study the above regulations and contact the competent authority in the locality for resolution.
