Ms. Nguyen Thi Ha (name of the character changed, in Lang Son) said that she is working as a contract employee under Decree 111/2022/ND-CP of the Government, signed a contract according to expertise, professional qualifications and ranked salary according to Decree 204/2004/ND-CP.
According to her understanding, Decree 73/2024/ND-CP of the Government stipulates bonuses for this group of subjects. However, from 2024 to now, she has not been entitled to the above-mentioned bonus because she has not been granted a source; in which, the code 18 bonus source is only allocated to pay officials, civil servants, and public employees. This is explained by Circular 62/2024/TT-BTC not summarizing the subjects of contract workers according to Decree 73/2024/ND-CP.
According to Ms. Ha, many units have based on Circular 62/2024/TT-BTC to exclude contract workers from the category eligible for bonus payment from source 18, and at the same time request the unit to self-balance the budget for payment.
Meanwhile, on the Ministry of Finance's electronic information portal, there is an answer stating that the use of the code 18 reward fund to pay for contract workers is appropriate.
From the above reality, Ms. Nguyen Thi Ha proposed that the Ministry of Home Affairs and the Ministry of Finance soon clarify relevant regulations, in order to ensure the rights of contract workers, avoiding the situation where workers are not entitled to the regimes that should have been enjoyed according to regulations.
Regarding Ms. Ha's reflection and recommendations, the Ministry of Home Affairs has feedback on the Electronic Information Portal.
On June 30, 2024, the Government issued Decree No. 73/2024/ND-CP stipulating the base salary and bonus regime for cadres, civil servants, public employees and armed forces.
In which, Clause 1 and Clause 2, Article 4 of this Decree have stipulated the subjects implementing the bonus regime and assigned the heads of competent agencies to manage or be decentralized the authority to manage cadres, civil servants and heads of public non-business units to be responsible for building specific Regulations to implement the bonus regime applied to subjects in the payroll of agencies and units.
The organization of policy implementation for cadres, civil servants, and public employees in Lang Son province is under the authority of the Chairman of the Provincial People's Committee.
Therefore, the Ministry of Home Affairs requested her to contact the agency managing cadres, civil servants, and public employees of Lang Son province (Department of Home Affairs) for answers.
