Youme Law Firm LLC said that in Report 219/BC-BNV in 2025, supplementing and perfecting the Plan to reorganize and streamline the Government's apparatus, the name of the Ministry of Home Affairs will remain the same after merging the Ministry of Labor, Invalids and Social Affairs (MOLISA) and the Ministry of Home Affairs.
On February 18, 2025, the Ministry of Home Affairs will be merged with the Ministry of Labor, War Invalids and Social Affairs under Resolution 176/2025/QH15. Previously, in the organizational structure of the Ministry of Home Affairs, there were 20 units as prescribed in Article 3 of Decree 63/2022/ND-CP, while the Ministry of Labor, Invalids and Social Affairs had 21 units as prescribed in Article 3 of Decree 62/2022/ND-CP, now consolidated to 22 units from March 1, 2025 as prescribed in Article 3 of Decree 25/2025/ND-CP, of which 18 units are administrative organizations assisting Ministers in performing their State management functions; 4 public service units, serving the State management function of the Ministry.
According to Clause 11, Article 2 of Decree 25/2025/ND-CP, after merging the Ministry of Labor, Invalids and Social Affairs and the Ministry of Home Affairs, from March 1, 2025, the Ministry of Home Affairs will help the Government unify State management of salary, labor and social insurance policies, specifically as follows:
- Assist the Government in unifying State management of labor, wages and social insurance according to the provisions of law;
- Guiding and organizing the implementation of legal regulations on labor contracts, labor discipline, material liability, dialogue at the workplace, collective bargaining, collective labor agreements and labor dispute resolution;
- Guiding the implementation of labor law provisions for female workers, underage workers, elderly workers, disabled workers, domestic helpers and some other workers;
- Guiding the registration and State management of the activities of labor representative organizations according to the provisions of labor law; performing the tasks of national units in the labor sector during Vietnam's participation in international trade agreements;
- Guiding the implementation of legal regulations on policies, salary regimes, allowances, living expenses, bonuses for cadres, civil servants, public employees from the central to commune levels and contract workers in State agencies and public service units;
- Guiding the implementation of legal regulations on minimum wages and salary policies for employees in enterprises, agencies, organizations, cooperatives, households, and individuals who hire and use labor according to the provisions of the Labor Code;
- Guidelines on salaries, bonuses and remuneration for employees, managers in state-owned enterprises, and enterprises with state investment capital;
- Research and advise competent authorities on implementing reforms in salary policies and social insurance policies.
