The reader is a civil servant who wishes to change job position after only 2 years of working in the old position.

During her work, Ms. Nguyen Thi Thanh Tam (Binh Duong) often had conflicts and could not agree on working views with her colleagues.

This affects the work efficiency and solidarity of the agency, and makes Ms. Tam herself feel tired. Therefore, Ms. Tam is wishing to change her job position, to another specialized department, and be relieved of her Inspector position.

Ms. Tam learned that according to the provisions of Clause 2, Article 25 of the 2018 Law on Anti-Corruption, the period for periodic job transfer is from 2 years to 5 years depending on the characteristics of each industry and field.

According to the provisions of Section XVIII of the Appendix to the List of job positions that must be periodically transferred in Decree No. 59/2019/ND-CP dated July 1, 2019 of the Government, including: Inspection work, citizen reception, handling complaints and denunciations, preventing and combating corruption of agencies, organizations and units; Civil servants assigned to perform specialized inspection tasks.

According to Article 4 of Circular 03/2021/TT-TTCP dated September 30, 2021 of the Government Inspectorate, the period for periodic job transfer in the field of inspection, citizen reception, complaint and denunciation settlement, and anti-corruption at local authorities is from 3 to 5 years.

"I plan to write a petition to the leadership to express my wishes, but my time as an inspector has only been 2 years, so is there a basis for my request to transfer to another job position to be approved by the leadership?" - Ms. Tam wondered and sent the question to the Ministry of Home Affairs.

Regarding this content, the Ministry of Home Affairs said: Regarding Ms. Tam's opinion on Article 25 of the 2018 Law on Anti-Corruption and Circular No. 03/2021/TT-TTCP dated September 30, 2021 of the Government Inspectorate, the Ministry of Home Affairs requests that she send her question to the Government Inspectorate for response according to its authority.

Discussing the above content, lawyer Nguyen Trong Nghia - Hanoi Bar Association - said that according to Circular 03/2021/TT-TTCP, the period for periodic job transfer in the inspection field is from 3 years to 5 years. The list of periodic job transfers includes the position of inspection.

"If the current job is difficult and not in line with their strengths, civil servants can submit a request to the head of their agency to mention the difficulties so that the agency can consider transferring them to a suitable job position. If the transfer is not considered, the civil servant must wait until the next periodic transfer period," said lawyer Nghia.
