Khanh Hoa Provincial People's Committee has just sent a document to relevant units on coordinating the handling of unpaid wages and social insurance at Mai Linh Nha Trang Company Limited.
Accordingly, the Chairman of the Provincial People's Committee requested the Provincial Social Insurance to continue urging the Company to urgently comply with Decision No. 3479/QD-XPHC, dated December 31, 2024 of the Chairman of the Provincial People's Committee on administrative sanctions in the field of social insurance for Mai Linh Nha Trang Company Limited, to be completed before August 30, 2025.
In case the company does not comply with the above decision, it will promptly advise on handling in accordance with regulations.
At the same time, the company's records related to social insurance violations were consolidated and the records were transferred to Khanh Hoa Provincial Police for consideration and handling according to regulations.
Khanh Hoa Provincial People's Committee also requested the Provincial Vietnam Fatherland Front Committee to direct the Provincial Federation of Labor to continue monitoring and urging the Company to fulfill its obligation to pay wages, social insurance... to employees until August 8, 2025, as committed at the meeting on May 8, 2025.
Support employees in carrying out necessary procedures at the request of employees to sue the company in court to request settlement of unpaid wages and social insurance debts, ensuring the rights of employees.
Assign the Department of Home Affairs to continue urging the company to implement Decision No. 47/QD-XPHC dated April 22, 2025 to sanction administrative violations in the field of labor against Mai Linh Nha Trang Company Limited, to be completed before August 30.
Carry out procedures and order according to authority to force the company to comply with the above decision in case of non-compliance.
Coordinate with relevant agencies to monitor, synthesize, and periodically report to the Provincial People's Committee on the 15th of each month on the progress of the case. Timely advise and propose to the Chairman of the Provincial People's Committee a solution to completely handle the case according to assigned functions and tasks.
The Chairman of the Provincial People's Committee requested relevant agencies to follow the prescribed functions and tasks, organize and implement drastically and thoroughly; report the implementation results to the Provincial People's Committee.
According to the Department of Home Affairs of Khanh Hoa, out of a total of 29 employees who submitted complaints and denunciations to the authorities, as of July 18, Mai Linh Nha Trang Company Limited has paid salaries to 19 employees. The company has paid social insurance in the amount of VND 236,844,145 to close the books for 3 employees.
The company has not yet complied with the payment of 2 administrative penalty decisions of the Provincial People's Committee and the Inspectorate of the Department of Home Affairs.
Since September 2024, many workers who have been working at Mai Linh Nha Trang Company Limited have sent a petition for help to the union and functional units about their long-term unpaid wages and social insurance.
From 2020 to January 2025, this Company owes from 1 to 11 months' salary to more than 100 employees with an amount of 2 billion VND, and owes 6 billion VND in social insurance. Of which, the debt of the old legal entities was more than 5.5 billion VND, the debt of the new legal entities was nearly 500 million VND.
Khanh Hoa Provincial Labor Federation and functional units have worked many times with representatives of Mai Linh Nha Trang Company Limited and Mai Linh Group. Up to now, the enterprise has only paid in small drops.
Meanwhile, many workers working here are upset because of long-term unpaid wages and social insurance debts and businesses continuously break their promises, despite signing a commitment to repay the debts to workers.
In many very difficult cases, even suffering from serious illnesses, when reaching retirement age, they still cannot exercise their rights because the business side is slow to pay social insurance.
