The Government has just issued Decree No. 361/2025/ND-CP regulating civil servant positions, effective from December 31, 2025.
According to the Decree, no later than July 1, 2026, ministries, branches, central agencies, provincial-level People's Committees, Offices of National Assembly Delegations and Provincial People's Councils must direct the organization of implementation and promulgation of decisions approving job positions of agencies and organizations under their management according to the provisions of this Decree to replace decisions on job positions previously issued.
During the time when the competent authority has not issued a decision approving the job position according to the provisions of this Decree, the decisions approving the job position issued earlier are continued to be applied.
No later than July 1, 2027, ministries, branches, central agencies, and localities must complete the arrangement for job positions and ranks corresponding to job positions for civil servants recruited before July 1, 2025 under their management. The arrangement for job positions and ranks corresponding shall be implemented as follows:
Appointment to positions of senior and equivalent specialists for civil servants holding senior and equivalent specialist ranks;
Appointment to the position of chief and equivalent specialist for civil servants holding the rank of chief and equivalent specialist;
Arranging for specialist and equivalent positions for civil servants holding specialist and equivalent ranks;
Arranging for positions of officials and equivalents for civil servants holding official and equivalent ranks;
Arranging for employee positions for civil servants holding the employee rank.
After being arranged into job positions and ranked accordingly, in case the agency using it has an actual number exceeding the ratio specified in this Decree, the competent authority shall carry out the arrangement and arrangement to ensure that after July 1, 2027, the ratio is implemented according to regulations.
During this time, do not implement job position changes with civil servant ranks ranked according to professional qualifications and skills from low to high for job positions that have exceeded the rate according to regulations.
This Decree applies to:
Ministries, ministerial-level agencies, organizations established by the Government and the Prime Minister that are not public non-business units in cases where they are assigned the authority to manage civil servants; agencies and administrative organizations under the ministry;
Provincial and city People's Committees; specialized agencies, agencies, and administrative organizations under provincial-level People's Committees; Offices of the National Assembly Delegation and People's Councils of provinces and cities;
People's Committees of communes, wards, special zones; specialized agencies, administrative organizations under commune-level People's Committees.
Competent Party agencies regulate the list of job positions and the proportion of civil servants arranged according to job positions in agencies of the Communist Party of Vietnam, the Vietnam Fatherland Front, and socio-political organizations.
The National Assembly Standing Committee, the Office of the President, the Chief Justice of the Supreme People's Court, the Director of the Supreme People's Procuracy, and the State Auditor General decide on the application of the provisions of this Decree to civil servants in agencies and administrative apparatus assisting work under their management.
The Minister of National Defense and the Minister of Public Security decide on the application of the provisions of this Decree to civil servants working in agencies, organizations, and units under their management.
