At the 31st Session of the Lang Son Provincial People's Council, Mr. Ho Tien Thieu - Chairman of the Provincial People's Committee accepted the responsibility of the head for the delay in issuing legal documents (VBQPPL) guiding the implementation of the 2024 Land Law in the province.
Accordingly, the 2024 Land Law takes effect from January 1, 2025, but then, based on the requirements of the actual situation, the Government proposed that the National Assembly adjust the law so that it takes effect from August 1, 2024, 5 months earlier than the initial decision.
In Official Dispatch No. 109/CD-TTg dated October 22, 2024, the Prime Minister criticized and requested 6 provinces and cities to review, including Lang Son province.
Regarding the reason for the delay in promulgating legal documents guiding the implementation of the Land Law in the province, the head of Lang Son province said that because the law took effect 5 months early, it affected the determined roadmap for developing legal documents.
On the other hand, the 2024 Land Law has many new points, complex content and is built in the direction of promoting decentralization and delegation of power to local authorities.
The total number of laws and decrees assigned to localities to regulate is 60, of which 20 are assigned by law and 40 are assigned by Government decree. Therefore, the amount of work to be completed is very large, concentrated in a short period of time.
The contents of the laws and decrees assigned to the province to promulgate include many contents that are specific policies of the province and have a wide scope of influence, so they must be carefully studied.
The issued documents must comply with the order and procedures according to the Law on Promulgation of Legal Documents, some documents must have the opinions of the Provincial Fatherland Front, so it takes time. The staff of the Department of Natural Resources and Environment is limited but in a short time must complete a large amount of work, so it is overloaded.
The Chairman of the Provincial People's Committee affirmed that the primary responsibility belongs to the Department of Natural Resources and Environment, the Department of Agriculture and Rural Development, and the Department of Planning and Investment, which are specialized agencies assigned the task of developing policies.
Then there is the responsibility of the Vice Chairman who is directly assigned to be in charge of the field and the responsibility of the Chairman of the Provincial People's Committee as the head.
Accordingly, the Provincial People's Committee has reviewed 6 groups and 54 individuals and reported to the Prime Minister and the Standing Committee of the Provincial Party Committee.
