Research on public service regime for civil servants

The Ministry of Home Affairs is studying and completing the dossier to propose the Law on Cadres and Civil Servants (amended).

Voters of Ninh Binh province proposed the Ministry of Home Affairs advice to the National Assembly and the Government to study and amend the Law on Cadres and Civil Servants in the direction of stipulating that State cadres and civil servants have 4 levels: Central, provincial, district, and communal.

Voters believe that this contributes to creating conditions for commune-level civil servants to work with peace of mind, actively contributing to the overall socio-economic development at the grassroots level.

Regarding this issue, the Ministry of Home Affairs said: Civil servants are Vietnamese citizens, recruited, appointed to ranks, positions, titles, on the payroll, receiving salaries from the State budget and belonging to agencies and units specifically stated in Decree 06/2010/ND-CP including:

In the agencies of the Communist Party of Vietnam; In the Office of the President, Office of the National Assembly, State Audit; In the Ministries, ministerial-level agencies and other organizations established by the Government and the Prime Minister;

In administrative agencies at provincial and district levels; In the People's Court system, the People's Procuracy system; In agencies of socio-political organizations at the central, provincial and district levels; In agencies and units of the People's Army and People's Police.

Pursuant to Article 34 of the Law on Cadres and Civil Servants 2008 (amended by Clause 4, Article 1 of the Law on Cadres and Civil Servants and the Law on Public Employees amended in 2019) regulating the classification of civil servants, the classification of civil servants is based on the following 2 bases:

Based on the field, profession, expertise, and profession, civil servants are classified according to the corresponding civil servant ranks.

Based on job position, civil servants are classified.

The Ministry of Home Affairs said that implementing Conclusion No. 19-KL/TW dated October 14, 2021 of the Politburo, Plan No. 81/KH-UBTVQH15 dated November 5, 2021 of the National Assembly Standing Committee, Decision No. 2114/QD-TTg dated December 16, 2021 of the Prime Minister and the direction of the Deputy Prime Minister of the Government, the Ministry of Home Affairs is coordinating with relevant agencies to complete the dossier to propose the development of the Law on Cadres and Civil Servants (amended).

The Ministry of Home Affairs acknowledges the recommendations of voters of Ninh Binh province for research and reporting to competent authorities for consideration of the unified implementation of public service regime for cadres and civil servants as recommended by voters.
