Responsibilities of localities in recruiting and using civil servants

Ministries, branches and localities have the authority and responsibility for recruiting, using and managing civil servants under their management authority.

The Government has issued Decree No. 170/2025/ND-CP regulating the recruitment, use and management of civil servants. This Decree takes effect from July 1, 2025.

The Ministry of Home Affairs said that, basically, the Decree is designed according to the principle of inheriting the contents stipulated in current Decrees that have been amended and supplemented in 2024 in Decree No. 116/2024/ND-CP and has been removed, adjusted, and supplemented to ensure compliance with the new regulations of the Law on Cadres and Civil Servants in 2025.

Accordingly, the Decree focuses on amending, adjusting, supplementing and replacing the following contents: Recruiting civil servants according to job positions; Arranging job positions for recruited civil servants, changing job positions and assigning civil servant ranks corresponding to job positions;

In addition, there is also a severance pay regime for civil servants; Responsibilities of ministries, branches and localities in the management of civil servants under their management authority.

Implementing the provisions of the Law on Cadres and Civil Servants 2025, Decree 170/2025/ND-CP continues to promote decentralization and delegation of authority, accordingly, ministries, branches and localities have the authority and responsibility in recruiting, using and managing civil servants under their management.

At the same time, it is stipulated that ministries, branches and localities shall decentralize recruitment authority to agencies, units and affiliated organizations.

In addition, the Decree determines and stipulates the authority and responsibility of the head of the agency employing civil servants in: arranging job positions for those who are recruited as civil servants; changing civil servant job positions.

Regarding the simplification of administrative procedures, Decree 170/2025/ND-CP does not stipulate the examination and consideration of civil servant promotion, accordingly, administrative procedures on examination and consideration of civil servant promotion will be abolished; at the same time, reduce the forms of regulation when recruiting civil servants.

In addition, to reduce administrative procedures, Decree 170/2025/ND-CP stipulates that it is not necessary to prepare appointment documents according to regulations in cases of changing the name of an agency, organization, or unit without changing the organizational model, the competent authority decides to change the position according to the new job position accordingly.

Decree 170/2025/ND-CP stipulates that the head of a civil servant management agency or an agency employing a civil servant is delegated the authority to recruit decision-making on termination of employment or authorized to decide on termination of employment for civil servants.

The Decree also specifically stipulates the order and procedures for handling termination of employment in cases where civil servants voluntarily resign and in cases where civil servants are allowed to be terminated.

Civil servants who voluntarily quit their jobs are entitled to severance pay such as: Receiving a subsidy of 3 months of current salary; receiving a subsidy of 1.5 months of current salary for each year of work with compulsory social insurance;

And are allowed to reserve the period of compulsory social insurance payment or receive one-time social insurance according to the provisions of the law on social insurance.
