On the Ministry of Construction's Information Portal, citizen N.M.T.H reflected: "I am completing an application to buy social housing, belonging to group 05 as prescribed in Clause 5, Article 76 of the Housing Law.
My case is no labor contract. According to the content of Decree No. 261/2025/ND-CP dated October 10, 2025, I will have my income conditions confirmed by the police agency at the commune level where I reside or temporarily reside or where I currently reside.
I have submitted a request for confirmation to the ward police, but until now there have been no results, and the officer in charge of the area where I live explained that there is no document guiding the implementation.
The deadline for submitting documents to buy social housing (where I intend to buy) is almost over, so let me ask, when will there be enough documents guiding the implementation of the above decree so that I and many other people with the same subject as me can complete the documents to buy social housing?".
Regarding this issue, the Ministry of Construction responded as follows:
On October 10, 2025, the Government issued Decree No. 261/2025/ND-CP on amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government and Decree No. 192/2025/ND-CP dated July 1, 2025 of the Government.
Accordingly, Clause 2, Article 1 has amended and supplemented Clause 1 and Clause 2, Article 30 of Decree No. 100/2024/ND-CP as follows: ... In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a labor contract, it must ensure the income conditions as prescribed in Clause 1 of this Article and be confirmed by the police agency at the commune level where the person is permanent or temporarily residing or currently residing.
Within 7 days from the date of receipt of the confirmation request, the police agency at the commune level where the subject is residing or temporarily residing or the place of residence at the time the subject requests confirmation shall base on the information of the population database to confirm the income conditions".
On November 10, 2025, the Minister of Construction issued Circular No. 32/2025/TT-BXD amending and supplementing a number of articles of Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction detailing a number of articles of the Housing Law.
In Form 05, in the Appendix issued with the Circular, there are instructions on documents proving income conditions for buying or renting social housing (applicable to subjects specified in Clause 5, Article 76 of the Housing Law without labor contracts, not entitled to salary paid by social insurance) confirmed by the police agency at the commune level where they are permanent or temporarily residing or currently residing.
The above is the opinion of the Ministry of Construction, requesting citizens to study and implement according to regulations.
