The draft decree of the Government on contracts for performing work in public non-business units drafted by the Ministry of Home Affairs is being appraised by the Ministry of Justice.
According to the draft decree, employees are paid salaries, bonuses, remuneration, and lease regimes corresponding to the results and products according to the agreement in the contract and according to the provisions of law.
Salary in the contract applies one of two forms:
First, apply salary levels according to agreements in accordance with the provisions of labor law.
Second, apply salaries according to the salary scale of public employees suitable to the financial capacity of public non-business units.
In case of agreement to apply salaries according to the salary scale of public employees, the types of allowances enjoyed (if any) are applied according to the agreement; salary grade promotion regime and other regimes and policies related to salaries are implemented as public employees.
Regarding the subjects of contract signing, the Ministry of Home Affairs proposed 3 specific job position groups.
Group one is for jobs in management positions including subjects: Experts, business managers, typical and outstanding entrepreneurs in fields suitable to their tasks; Good lawyers, lawyers, leading scientists, fields suitable to their tasks. People with high professional qualifications in strategic and key sectors suitable for the development of public non-business units.
Group two is for jobs in professional and nghiệp vụ positions and supportive job positions, including the above subjects; people with experience, professional understanding and having directly implemented similar tasks; people who meet the standards and conditions of the job position; and can also sign contracts with legal entities and individuals who are eligible to provide services.
The group three is for tasks serving the operation of public non-business units, including: People who meet the standards and conditions to meet the requirements of the task; Legal entities and individuals who meet the standards and conditions for providing services.
