Proposal to abolish the regulation on leadership position allowances of the Department under the General Department from January 1, 2026

The Ministry of Home Affairs proposes to adjust the leadership position allowances for cadres, civil servants, public employees and armed forces from January 1, 2026.

The Ministry of Justice is reviewing the draft Decree amending and supplementing a number of articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces.

The draft Decree drafted by the Ministry of Home Affairs is expected to take effect from January 1, 2026.

Notably, the Draft Decree amends and supplements the regulation on leadership position allowances for Departments under the Ministry, abolishing the regulation on leadership position allowances for Departments under the General Department.

Pursuant to Regulation No. 368-QD/TW of the Politburo, Conclusion No. 206-KL/TW dated November 10, 2025 of the Politburo and Decree No. 303/2025/ND-CP of the Government, it is necessary to abolish the regulation on leadership position allowances of Departments under the General Department and amend and supplement the regulation on leadership position allowances of Departments under the Ministry (Department 1 and Department 2) as follows:

First of all, for type 2 Departments, the draft Decree maintains the provisions on leadership position allowances for Departments under the Ministry in Decree No. 204/2004/ND-CP.

Next, for a Type 1 Department, the draft Decree stipulates that leadership position allowances for the positions of Director, Deputy Director, Head of Department, Deputy Head of Department are 0.10 higher than the corresponding positions under a Type 2 Department. Specifically: Director: 1.10; Deputy Director: 0.9; Head of Department: 0.7, Deputy Head of Department: 0.5.

The draft adds leadership allowances for leadership positions of regional agencies and branches with the principle that the leadership allowance coefficient of the Head of the Department is equal to the Head of the Area, equal to the Head of the Branch (coefficient is 0.7) because currently some regional agencies under the Department under the Ministry are also branches (Customs Department, State Reserve Department...), and at the same time facilitates the transfer and rotation of cadres from the area and branch to advisory committees under the Department.

Draft to supplement leadership allowances for leadership positions under the department as prescribed in Decree No. 303/2025/ND-CP, including department under the department and team under the department: Head: 0.3, deputy head: 0.2 (equal to department level of the public service unit under the Department).
