According to the Department of Home Affairs of Lang Son province, implementing the direction of the Central Government, the associations assigned by the Party and the State (provincial level) in the province have now been transferred to the Vietnam Fatherland Front Committee (VFF) of the province.
However, there is currently no specific document from the Central Government on the implementation of management work for these associations (civilian work, handling of regimes, policies, etc.), this work is currently being temporarily assigned by the Provincial Party Committee Standing Committee to the Provincial People's Committee to advise on until there are instructions.
Thus, the same association is organized but there are 2 different management agencies.
According to Project No. 20-DA/TU, associations assigned by the Party and the State at the commune level have ended their activities before July 1, 2025.
After the communes and wards are established, consider establishing 2 associations including: the Commune-level Association of the Elderly and the Commune-level Red Cross Society (on the basis of combining the functions and tasks of the Commune-level Red Cross Society and the Commune-level Dong - Doctor Association).
However, the implementation of the establishment of the above associations is currently suspended because the competent authority for granting the establishment has not been determined.
Regarding the above content, the Ministry of Home Affairs issued an official dispatch guiding a number of difficulties and problems as proposed by the Department of Home Affairs of Lang Son province.
In particular, the Ministry of Home Affairs said that the authority to handle Association procedures as prescribed in Clause 4, Article 15 of Decree No. 126/2024/ND-CP is as follows: The Chairman of the People's Committee at the commune level has the authority to recognize the association establishment mobilization committee; allow the establishment, division, separation, merger, consolidation, dissolution, renaming, charter approval; suspend activities for a period of time, allowing residence for associations operating within the commune as prescribed.
The authority to permit the establishment, merger, and consolidation of associations operating within the commune is the Chairman of the People's Committee at the commune level.
According to Conclusion No. 127-KL/TW dated February 28, 2025 of the Politburo, the Secretariat on the implementation of research and proposals to continue to reorganize the apparatus of the political system; Resolution No. 60-NQ/TW dated April 12, 2025 of the 11th Conference of the 13th Party Central Committee and Law No. 1997/2025/QH15 of the National Assembly amending and supplementing a number of articles of the Law on Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth and the Law on Grassroots Democracy, associations assigned by the Party and State under the Vietnam Fatherland Front.
The consolidation and improvement of the organization and operation of associations assigned by the Party and the State with scope of activities in localities according to the model of organizing local government at the two levels of provinces and communes is implemented according to Instruction No. 05/HD-MTTW-TT dated July 30, 2025 of the Standing Committee of the Central Committee of the Vietnam Fatherland Front on continuing to reorganize, streamline and merge mass associations assigned by the Party and the State at the provincial and commune levels.
Accordingly, the Standing Committee of the Vietnam Fatherland Front Committee at the commune level coordinates with local authorities in communes to guide mass associations assigned by the Party and State in communes to arrange and streamline the organization of the whole association, organize the Congress according to the Party's policy, Instruction No. 05/HD-MTTW-BTT and legal regulations to ensure unity and convenience in the organization and operation of local associations;
During the implementation process, if any problems arise, the Ministry of Home Affairs proposes to synthesize and report to the Central Committee of the Vietnam Fatherland Front for consideration and guidance according to regulations.
