The Ministry of Home Affairs has just completed the consultation on the draft Law on Civil Servants (amended), which includes mentioning the content of proposals to promote decentralization and delegation of authority; attracting, using, and promoting high-quality human resources in public service units.
The Ministry of Home Affairs said that the draft Law on Civil Servants (amended) focuses on reviewing and supplementing policies in the direction that public service units are proactive in the management and use of human resources, in line with the new policies of the Politburo and practice.
The goal is to form a flexible mechanism in recruitment for public service units to attract, arrange, use, treat, train, and foster civil servants, workers, experts, and scientists, in accordance with the human resource needs and financial conditions of the unit.
The contents of the draft also aim to allow public service units to operate as economic entities (for autonomous units); create a flexible mechanism in recruitment, evaluation, and use in accordance with the level of autonomy on the basis of ensuring the principle of community service; a flexible team management mechanism in the direction of openness, adapting to all organizational models; a mechanism of sufficient openness for each unit to "professionalally design" the way to manage, use, and recruit its own team.
In particular, the Ministry of Home Affairs proposes to implement the principle of decentralization and delegation of authority corresponding to the level of autonomy of the public service unit, ensuring comprehensive initiative in personnel associated with the responsibility of the head of the public service unit in managing and controlling personnel and other resources.
In particular, highly autonomous public service units have the right to decide on the number of employees; increase the level of autonomy in recruitment, use, management, planning, and appointment of heads of public service units.
Public service units in general are allowed to choose appropriate forms of civil servant recruitment according to the level of autonomy, requirements of job positions and characteristics of the unit.
The public service unit can sign contracts directly with experts, scientists, and talented people suitable to the unit's field of activity, creating favorable conditions for the unit to attract high-quality, experienced and deep-level personnel that the traditional admission process may not be able to meet.
The unit can also accept civil servants who have experience in immediately meeting the requirements of job positions working in the non-public sector, helping the unit add a team of capable personnel, ready to start work, saving time and initial training costs.
In particular, the Ministry proposes that public service units proactively develop Regulations on assessment, salary, bonus, and discipline specifically applied to the unit, close to the specific tasks, organizational model and goals of each unit. From there, the assessment becomes more fair, objective and effective, promoting civil servants to maximize their capacity.
