The Ministry of Home Affairs has issued guidance on salary ranking for commune-level cadres and civil servants with changes in professional qualifications and duties to the Department of Home Affairs of Khanh Hoa province.
Accordingly, the Department of Home Affairs of Khanh Hoa province said that Clause 1, Clause 2, Article 16 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government, stipulates:
Commune-level cadres and civil servants who have completed training according to the standards for professional qualifications and duties specified in this Decree are ranked as administrative civil servants with the same training qualifications specified in the professional and duty salary scale for cadres and civil servants in state agencies issued together with the Government's Decree on the salary regime for cadres, civil servants, public employees and armed forces.
Certificates of aptitude for training are issued according to the regulations of the Ministry of Education and Training and of competent agencies and organizations issuing certificates.
In case during their working time, commune-level cadres and civil servants have changes in training qualifications suitable to their positions and titles, they are proposed to the Chairman of the District-level People's Committee to arrange salaries according to the new training qualifications from the date of being granted the diploma.
However, Clause 3, Article 71 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government stipulates: Abolishing the relevant regulations on commune-level civil servants in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government stipulating cadres, commune-level civil servants and non-specialized personnel at the commune level, in villages and residential groups.
Thus, this Department wonders whether for cadres and civil servants working in communes, wards, and towns who were previously arranged to receive salaries for employee ranks and civil servant ranks, and during their working time, commune-level cadres and civil servants had changes in their training qualifications suitable to their positions and titles, they would be classified as specialist ranks as stipulated in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government or not?
Similarly, for civil servants who previously worked in professional departments under the district level and were entitled to salaries of cadre ranks and staff ranks after being arranged into commune-level civil servants in new administrative units from July 1, 2025 with university degrees, is the salary transfer based on professional qualifications applied to commune-level cadres and civil servants who are subjects specified in Decree No. 33 mentioned above?
To ensure the rights of these cases, the Department requests the Ministry of Home Affairs to provide specific guidance on salary ranking for the above cases.
Regarding the above content, the Ministry of Home Affairs said that, based on the Law on Cadres and Civil Servants and Clause 3, Article 71 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government stipulating: "Abolishing relevant regulations on commune-level civil servants in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government stipulating cadres, commune-level civil servants and non-specialized personnel at the commune level, in villages and residential groups".
Accordingly, the salary ranking for commune-level civil servants is implemented uniformly according to the common salary regime applied to cadres and civil servants according to the Government's regulations.
