The Government has issued Decree 178/2024/ND-CP on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system.
The principles for implementing policies and regimes are clearly stated in Article 3 of this Decree:
Ensure the leadership of the Party, promote the supervisory role of the Vietnam Fatherland Front and socio-political organizations and people in the process of implementing policies and regimes.
Ensure the principles of democratic centralism, objectivity, fairness, openness, transparency and compliance with the law.
Notably, a principle stated in the Decree is: To ensure that no later than 5 years from the effective date of the decision on organizational restructuring of the competent authority, the number of leaders, managers and the number of cadres, civil servants, public employees and workers in agencies, organizations and units in the political system after the restructuring is in accordance with regulations.
Ensure timely and complete payment of policies and regimes in accordance with the law; use the state budget correctly and effectively.
Each agency, organization, and unit must conduct a comprehensive review and assessment of cadres, civil servants, public employees, and workers in an impartial and objective manner based on the assessment of the qualities, capacities, performance results, and level of task completion according to the job position requirements of cadres, civil servants, public employees, and workers; on that basis, arrange and streamline the payroll and implement policies and regimes for cadres, civil servants, public employees, and workers.
The collective leadership of the Party Committee, government and heads of agencies, organizations and units are responsible for evaluating, screening and selecting candidates for resignation, along with restructuring and improving the quality of the staff, civil servants and public employees under their management so that the agencies, organizations and units can operate effectively, efficiently and effectively.
In this Decree, the Government also emphasizes the principle that a subject eligible for many policies and regimes stipulated in different documents shall only enjoy the highest policy and regime.
Ministries, departments, and branches at the central level and agencies, organizations, and units at the provincial level must send about 5% of cadres, civil servants, and public employees on the payroll of the agency, organization, or unit to work at the grassroots level.
At the regular Government press conference in January 2025 held on February 5, Chief of Office, Spokesperson of the Ministry of Home Affairs Vu Dang Minh said: In 5 years, the expected source of funding from the state budget to pay policies and regimes for retirement and termination cases will still be lower than the source of funding from the state budget to pay salaries and other expenses if they continue to work. Thus, we still ensure a balance of sources for payment.
According to Mr. Vu Dang Minh, currently, ministries, branches and localities have specific plans on arrangement, organization and very specific numbers.
Regarding the calculation of personnel for which positions, the Spokesperson of the Ministry of Home Affairs said that it is necessary to wait for the National Assembly to approve the organizational structure before the Government issues a Decree stipulating the functions, tasks, and powers of ministries and branches.
