Duties and powers of the Inspectorate of the Ministry of National Defense according to new regulations

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 7 of Decree 284/2025/ND-CP stipulates the organization and operation of the National Defense Inspectorate (effective from November 6, 2025), stipulating that in inspection activities, the Ministry Inspectorate has the following duties and powers:

a) Inspect the implementation of policies, laws, tasks, powers, and state plans on national defense; regulations on national defense management, expertise - technique for agencies, units, organizations, and individuals in fields under the state management of the Ministry of National Defense;

b) Inspect the implementation of state policies, laws, tasks, powers and plans on national defense; orders, directives and decisions of the Minister of National Defense for agencies, units and individuals under the management of the Minister of National Defense; inspect enterprises in the Army established by the Minister of National Defense, enterprises established by the Prime Minister but directly under the management of the Ministry of National Defense;

c) Inspecting cases under authority when detecting signs of law violations; inspecting other cases assigned by the Minister of National Defense; re-inspecting cases with conclusions from the Military Region Inspectorate but detecting signs of law violations through reviewing, handling complaints, denunciations, recommendations, and reflections;

d) Check the accuracy and legality of inspection conclusions issued by the Chief Inspector of the Military Region, Chief Inspector of the Hanoi Capital Command (hereinafter referred to as the Chief Inspector of the Military Region) and decide to handle them after inspection by the Commander of the Military Region, Commander of the Hanoi Capital Command (hereinafter referred to as the Commander of the Military Region) when necessary;

d) Monitoring, urging, and inspecting the implementation of inspection conclusions and handling decisions on inspection by the Ministry Inspectorate and the Minister of National Defense;

e) Check the accuracy and legality of the decision to handle after inspection by the Chairman of the Provincial People's Committee for a case under the state management of the Ministry of National Defense when necessary.

Thus, the duties and powers of the Inspectorate of the Ministry of National Defense are prescribed as above.
