Regulations on highway usage fees

Lao Dong Newspaper Legal Consulting Office replied:

Article 50 of the 2024 Road Law (effective from October 1, 2024) stipulates highway usage fees as follows:

1. The State collects highway usage fees for vehicles traveling on highways owned by the entire people and directly managed and operated by the State, including:

a) Expressways invested by the State in the form of public investment;

b) Expressways invested in other forms when the contract ends, are transferred to the State.

2. Management and use of revenue from highway usage fees are regulated as follows:

a) The road management agency organizing the exploitation of assets shall pay the collected fees to the state budget according to the provisions of law on fees and charges;

b) The organization receiving the franchise fee collection and business and management franchise shall pay the franchise fee to the state budget; the fee amount collected during the performance of the transfer contract shall not be paid to the state budget, except for the revenue portion that must be shared with the State according to the provisions of law.

3. The Government shall prescribe the conditions and time for collecting highway usage fees; the collection of highway usage fees for highways falling under the cases specified in Clause 1 of this Article that do not satisfy the provisions in Clause 1, Article 45 and Clause 2, Article 47 of this Law.

Thus, highway usage fees are regulated as above.
