Dak Nong voters reflected that currently, the Law on Fees and Charges and related legal documents only stipulate annual road use fees collected on vehicles. This law does not yet regulate the collection of road use fees through expressway stations invested by the State.
Therefore, currently, taxes and fees such as special consumption tax, road maintenance fees, environmental protection tax via gasoline, registration fees, etc. have been calculated and collected by means of transport.
However, if drivers still pay the fee when passing through the toll station, will there be a phenomenon of " fee overlapping fee"?
In addition, is it fair for vehicles running under the service business method to be charged the same fee as non-business vehicles; there should be regulations on discrimination to ensure harmonious benefits for people.
Regarding the content of the above voters' petition, the Ministry of Transport said:
On June 27, 2024, the Road Law was passed by the 15th National Assembly at the 7th Session, which includes regulations on collecting highway tolls for vehicles traveling on expressways owned by the entire people and directly managed and operated by the State.
To implement the Road Law, the Government issued Decree No. 130/2024/ND-CP dated October 10, 2024 regulating the collection of highway tolls for vehicles traveling on expressways owned by the entire people and directly managed and exploited by the State.
The Decree specifically stipulates the conditions and time for collecting highway tolls; highway tolls.
The highway usage fee is studied and developed in accordance with the principles of the Law on Fees and Charges, basically determined to ensure compensation for related costs (management costs, organization and operation costs, fee collection, highway maintenance costs, etc.), taking into account the State's socio-economic development policies; ensuring fairness, publicity, and transparency.
The prescribed fee has deducted related taxes and fees, avoiding the collection of fees that match fees; ensuring reasonableness and harmony with the fee for road and expressway use services invested in the form of PPP; expressway users sharing benefits with the state; the fee is lower than the benefits of expressway users.
Regarding the fee for cars used for transportation, the Ministry of Transport said that vehicles used on expressways owned by the entire people are owned by the State and directly managed and exploited to pay the fee by stage (according to the number of kilometers used). Therefore, the highway usage fee does not distinguish between vehicles used for transportation and vehicles not used for transportation.
