Before September 1, 2025, Mr. Ha Xuan Vinh (Hue) has been teaching at a college for 17 years, with a doctorate degree. He has completed the application for promotion to the title of Professional Education Lecturer rank II (code V.09. 02.02) and the required conditions have been met.
From September 1, 2025, Mr. Vinh will transfer to teach at a university in the same area with the same expertise as his previous teaching.
On September 22, 2025, he was informed that he had been recruited for the title of Professional Education Lecturer rank II. However, he is currently working at the university. Mr. Vinh asked, according to the provisions of Article 41 of Decree No. 115/2020/ND-CP, in his case, can he use the results of being recruited for promotion to Professional Education Lecturer rank II to consider special consideration for the professional title of Chief Lecturer (code V.07. 01. 02) at the university after completing his working time?
Regarding this issue, the Ministry of Education and Training (MOET) answers as follows:
Based on Article 31 and Article 41 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government stipulating the recruitment, use and management of public employees, the consideration for promotion or special consideration for appointment to professional titles of public employees must be based on the job position, corresponding professional title standards and the needs of the public non-business unit where the public employee is working.
According to the content stated in the official dispatch, at the time of announcing the admission for the title of Professional Education Lecturer rank II (code number V.09. 02.02) on September 22, 2025, Mr. Ha Xuan Vinh had transferred to teach at a university from September 1, 2025, so he is no longer subject to the application of the professional title of professional education lecturer.
Therefore, the results of winning the title of Professional Education Lecturer rank II do not serve as a basis for considering special consideration and appointing the title of Chief Lecturer (code number V.07. 01. 02) at a higher education institution.
